Malaka case to be taken up tomorrow

Malaka Silva and Rehan Wijeyrathne together with the Army Major who was allegedly assaulted were issued notice to be present at the Fort Magistrate court tomorrow in order to take a decision on the case.

Both parties filed two motions urging the court to take up the matter tomorrow instead of September 24 and 25 as previously ordered.

When the Magistrate asked the lawyer representing the Army Major as to why the Major did not declare the facts stated in the subsequent bt affidavit previously, the lawyer said that the Army Major was suffering from shock. (LS)

When one considers how meekly an army major has surrendered in the face of threats by a thug Minister and his family, one wonders if it is the same army who fought the world's most ruthless terrorist outfit and vanquished them. That was some other time when the army was led by a brave hero called General Fonseka. Now it is obvious that the army is run by a politically appointed wimp who is at the beck and call of the government. The ultimate price has to be paid by the officers on foot. Wonder how this so called Major is going to face the public now.

First Duminda, now the the Major. This is setting a bad precedence. Very soon no criminal will be brought to justice if they can get away by making such stupid excuses. Hope the Magistrate takes stern action irrespective of shock and amnesia and hope no doctor will condone such statements.

What case will be taken up tomorrow? Because to all intents and purposes the Major assaulted himself. He has given an affidavit via his lawyer to say almost that. So is the Major going to be charged for assaulting himself? I dont think there is a law against that in our penal code. i.e. Self Assault.
