Decision on Duminda on May 2
Colombo Additional Magistrate Priyantha Liyanage today reserved order for May 2 on whether to indict parliamentarian Duminda Silva and 12 others in the High Court on charges of killing of presidential advisor Bharatha Lakshman Premachandra and three others on October 10, 2011. At the conclusion of his non summary inquiry into the killing, the Magistrate observed that it had been affirmed that Mr. Silva and 12 other suspects could be indicted on charges of unlawful assembly and the killing of Mr. Premachandra and three others while causing grievous injuries to Mr. Premachandra’s official body guard R. Gamini.
When the Magistrate asked the accused whether they pleaded guilty or not guilty to the charges, they pleaded not guilty and their counsel informed the Magistrate that the accused would not make dock statements or lead evidence for the defense at this stage.
However, they said they would make dock statements or lead the evidence for the defense in the High Court if necessary and make use of the written and oral submissions made in court during the non-summary proceedings to decide whether to indict the suspects in the High Court.
Duminda Silva, his official body guard Thushara De Mel, Chandana Jagath Kumara, Chaminda Ravi Jayanath, Lanka Rasanjana, Malaka Sameera, Vidanagamage Amila, Sarath Bandara, Suranga Premalal, Kumara Abeysinghe, Janaka Bandara Galaboda (absconding), Rohana Marasinghe and Nagoda Liyanarachchige Chaminda are accused of killing Bharatha Lakshman Premachandra, Damitha Dharshana Jayathilaka, Jailabdeen Mohamed Azmy and Manimel Kumaraswamy and inflicting gunshot injuries to Mr Premachandra’s bodyguard Rajapurage Gamini at Walpola Junction.
