The Attorney General today informed the Colombo Magistrate that Bharatha Lakshman Premachandra’s driver who was a prime witness in the Mulleriyawa shooting has now changed his stance stating in an affidavit that the earlier statement was made under undue ‘influence’ by various parties to the case.
Senior State Counsel Madhawa Tennakoon revealed this to Colombo Additional Magistrate Prassana De Alwis during the magisterial inquiry into the Mulleriyawa shooting.
The Counsel said witness Don Liyanage Saman Shantha Perera in an affidavit had informed the Attorney General that he had made that statement to the CID after the shooting incident on the instructions and pressure from certain parties involved into the incident.
Mr. Tennakoon said the witness in his affidavit under Clause 13 admitted that he was forced to make that statement by some parties involved in the case and by clause 14 admitted he had changed his position now. The counsel said the witness had withdrawn the earlier statement made by him to the CID.
Mr. Tennakoon said the prosecution had submitted to the Attorney General all necessary documents except for a few DNA reports.
He said the Counsel for the defense and the aggrieved parties had made submissions to the AG on legal subjective issues and after meticulously studying the reports the AG would indict the culprits, leaving the others out on the next date of the case.
Counsel Hemantha Warnakulasuriya PC appearing for Duminda Silva submitted that his client who is a victim in the case was made a suspect in an unreasonable manner due to political interference.
Counsel Upul Kumarapperuma appearing for Mr. Premachandra’s wife objecting to what Mr. Warnakulasuriya said the incident took place between two factions of the UPFA.
Presidential adviser Bharatha Lakshman Premachandra and four others were killed while UPFA Parliamentarian Duminda Silva was seriously injured.
Magistrate postponed the case for February 5 and the suspects were further remanded.(T. Farook Thajudeen)

Hey, let's wait till we face some injustice, then we can loudly complain about it and have justice be served to us. I'm sure everyone will come to our aid the day we face injustice.

During Premadasa and JR s time people went on tires.Billas were everywhere and Gonawala Sunil and Soththi Upali bore UNP executive committee posts. Now skeletons coming from mass graves (74 skeletons up to now) showed the horrible killings death squads made during that time. Ranil was running the Batalanda torture camp.Duminda came from UNP as well and all the trouble makers came from UNP.It is time to kick all these parasites out from the government.

Why shouldnt he change his mind Senavi? Late Baratha's Wife and Daughter, both are on regime side and enjoy the luxury offered to them. I have a doubt if they were too on Duminda's side. Let this poor man also get something if not he will be vanished.

This is Justice Sri Lanka style. The accused always gets away with murder as the witnesses recant under pressure. What do you expect in a country where even the Chief Justice does not get a fair trial.. The thugs murderers drug dealers and political helpers survive. We people are the losers that live in the miracle of Asia..

Bharatha's wife and daughter must take a lesson from Rizana's mother about dignity in the face of untold cruelty, poverty and injustice. Rizana's family refused any money from Saudis. Somethings in life cannot be bought.

"Change of stance" again eh? May be he learnt a bit from the "Major" who got to trouble with Malaka Ayya.
180 degree turns in legal and civil right positions are very well known to be solid indicators of threats or bribes that challenge the rule of law. In the rest of the world, this is grounds for intensified investigations and often those who change their minds and stories are charged. But hey! This is Sri Lanka!!

IF this trend continues... the court system is gonna be a mockery.. The Accused will say he/she was pressured to make a claim of responsibility and then the witnesses will say they were threatened.. Justice will NOT be meted out to the grieving parties. It's gonna be a case of " who knows who" in the higher echolans... and the LAWYERS, who to me are professional LIARS will fish in troubled water and make their bank accounts even more fat..... R.I.P Justice....

Not an unexpected development. Duminda Silva is on his way to being completely exonerated.
This is the kind of justice Bharatha's family can expect under Rajapaksa's misrule.

This is how the police manipulate cases. At first it was due to pressure from some parties. then it is the inducement from the opposite parties. Strange!

Bharatha’s wife changed her stance by accepting a job at Presidential Secretariat with same perks which Baratha used to get. Then Bharatha’s daughter changed her stance by appearing on ruling party election stage canvassing for the ruling party. So, now it is his driver, no surprise at all!

This case must be heard by a UPFA committee, just like the rope case involving Honorable Dr, Mervin. Ms Pavithra or Anura P are competent to handle it.
A typical Sri Lankan drama with happy end............. to the majority (I meant to 2/3rd majority)
