Colombo, Feb. 5 (Daily Mirror) - Colombo Chief Magistrate Asanga S. Bodaragama ordered that a warrant be issued for the arrest of the former Chief Financial Officer of Sri Lanka Cricket, Piyal Nandana Dissanayake, against whom charges have been filed over the alleged misappropriation of USD 187,000.
The order was made in connection with a case filed by the Financial Crimes Investigation Division in 2018.
At the previous hearings, court was informed that although the suspect had appeared at every hearing at the initial stage of the case, he had subsequently obtained court permission to travel overseas. Thereafter, in terms of Section 192 of the Code of Criminal Procedure Act, No. 15 of 1979, which permits a trial to proceed in the absence of the accused, his counsel appeared on his behalf for a period of two years.
When the case was taken up today, President’s Counsel Kalinga Indatissa informed court that his client had filed a complaint against the complainant party with the Criminal Investigation Department and that the investigation had been concluded, proving his client’s innocence.
Accordingly, he requested that his client be discharged from the case.
Counsel further stated that the suspect had not absconded from court and that his absence had been with the permission of court, obtained under Section 192 of the Code of Criminal Procedure Act.
After considering the submissions, the Magistrate stated that, as the case had been referred for the Attorney General’s advice, it was not possible to grant further permission for the suspect to be absent from court.
The Magistrate then issued a warrant and ordered that the further hearing of the case be taken up again on September 30.
