As a major contribution to the industry, we are pleased to introduce the Mediation center launched by the Ceylon Institute of Builders for resolution of mediation of disputes, particularly of the Construction sector. Already, we have been requested by a number of a construction company to mediate to resolve issues arisen in their construction agreements with clients and other parties.
Mediation process is being introduced with the initiative of the EEJ programme of USAID. It is an entirely independent and voluntary process where CIOB will facilitate discussion with the two parties and attempt to reach an amicable solution. In the event of reaching a compromise one could enter into a formal agreement with the other party which will be binding. On the other hand, if an agreement cannot be reached in the mediation process, both parties will be completely free to adapt alternative means.
We would however urge the construction companies to make use of this mediation process hopefully for a solution which would be much less costly.
