Sarath and Senaka case postponed for Jan. 23

The Colombo High Court today postponed for January 23, the case in which former Army Commander Sarath Fonseka and his Personal Assistant Senaka Haripriya de Silva were indicted for committing mutiny, in-subordination to the government and harbouring army deserters.

The counsel for Mr. Fonseka informed the court that Senior Counsel Nalin Ladduwahetty who had defended him in the White Flag case had been nominated as the Senior Counsel to defend him again in this case and moved for a further date for the trial.

Senior State Counsel Damith Totawatte appearing for the state objected to the move as the defence was habitually moving for dates for the trial.

High Court Judge Ms. Deepali Wijesundera on considering the counsel’s submissions postponed the case for November 14.

The Attorney General indicted the accused under Sections 128 and 133 of the Penal code for committing mutiny, in-subordination by the suspects to the government and harbouring army deserters knowingly, which are punishable offences under the Penal Code.

Counsel Asela Mutumudalige and Chatura Amarasinghe instructed by Paul Ratnayake associates appeared for the first accused Sarath Fonseka and Counsel Upul Jayasuriya with Kalum Kumarasinghe appeared for the second accused Senaka Haripriya de Silva. (T. Farook Thajudeen)
