Jeena Madam’s women acquitted

The eight women, who had been arrested on October 24, 2007 along with Rosemary Felicia Perera alias Jeena Madam on charges of having helped operate a brothel under the guise of a night club at the Kollupitiya Liberty Plaza building complex, were acquitted today by a Colombo Court.
 
The main accused Rosemary Felicia Perera has been indicted in the Colombo High Court on charges of procuring women for prostitution and as such she was released from this particular case.
 
The eight women were charged in the Colombo Fort Magistrate’s Court under section 2(a) of the Brothels’ Ordinance on the instructions of the Attorney General.
 
When the case was taken up for inquiry, the defence counsel argued that the women who were at the brothel could not be charged with assisting the management of a brothel.
 
The counsel said these women were not empowered to operate such a brothel and as such the relevant section of the ordinance could not be applied against them and further the charge sheets filed against the eight women were ambiguous.
 
The defence counsel said there was no provision under Section 2(a) of the Brothels Ordinance to convict or charge any woman found in a brothel.
 
Considering the submissions, Colombo Fort Magistrate Lanka Jayaratne observed that a woman found in a brothel for the purposes of consorting men could not be said to be assisting in the management of a brothel within the meaning of section 2(a) of the Brothels Ordinance.
 
She further observed that according to the police decoy it had also been proved that the eight women had not been there for the purpose of assisting the management of a brothel and as such she ordered that they be acquitted. (Lakmal Sooriyagoda)
