President’s statement on judicial decision erodes public confidence in the Judiciary: BASL

Colombo, May 5 (Daily Mirror) - The Bar Association of Sri Lanka (BASL) has expressed grave concern over remarks made by President Anura Kumara Dissanayake during his recent May Day rally, warning that such statements could undermine public confidence in the judiciary.

In a statement issued today, the BASL referred to the President’s comments about a judicial decision scheduled to be delivered on May 25, 2026, during which he told supporters they would be able to applaud the outcome when it is announced. 

The BASL, one of country’s largest professional bodies noted that the tenor of the statement gives rise to concerns about possible interference with the judicial process.
“The statement is open to the suggestion that there is interference with the judicial process,” the BASL said.

Emphasizing the central role of an independent judiciary in a democratic society, the BASL reiterated that the rule of law depends on the ability of judges to act without fear or favour. “An independent judiciary stands as the bedrock of a vibrant and enduring democracy,” the statement said.

The BASL also drew attention to constitutional provisions that guarantee judicial independence. It cited the Preamble to the Constitution, which recognizes the independence of the judiciary as part of the nation’s intangible heritage, ensuring the dignity and well-being of future generations.

Further, the BASL referenced Article 111C(1) of the Constitution, which mandates that all individuals entrusted with judicial powers must exercise their duties free from external direction or interference, except as permitted by law. It also noted that Article 111C(2) makes any such interference an offence.

The BASL stressed that judicial independence is not merely an institutional safeguard but a fundamental pillar in preserving the dignity of individuals and maintaining the moral authority of a democratic society.

Recalling its longstanding position, the BASL stated that it has consistently opposed any threats to the judiciary, whether from the executive or other quarters. It reaffirmed its commitment to protecting the independence and integrity of the judicial system.

“The BASL will take all necessary steps to ensure that the independence of the judiciary is protected at all times,” the statement added, pledging continued action in the interests of democracy, the rule of law, and the safeguarding of the Constitution.
