Court of Appeal issues notice to Sanath Nishantha over alleged contemptuous statement

The Court of Appeal today issued notices on Sri Lanka Podujana Peramuna (SLPP) parliamentarian Sanath Nishantha to appear in court on September 13 over two contempt of court cases filed by two lawyers.

The lawyers Vijitha Kumara and Priyalal Sirisena had filed these applications against Puttlalam District Parliamentarian Sanath Nishantha for committing the offence of Contempt of Court under the provisions of constitution.

Court of Appeal two-judge-bench bench comprised Justice Nissanka Bandula Karunaratne and Justice R. Gurusinghe.

The Petitioners states that Sanath Nishantha has been named as a suspect in a case before Colombo Fort Magistrate's Court for attacking Galle Face protesters on May 9, 20222 and the investigations are still being carried out by the CID. 

The petitioners stated that on or around August 23, 2022, Sanath Nishantha addressing a press conference held at the party headquarters of the SLPP, made certain comments on the judiciary of Sri Lanka, especially in relation to the judicial officers.

The Petitioners state the remarks made by MP Sanath Nishantha are in Contempt of Court in as much as the said remarks are calculated to undermine the authority of the judiciary including the court of first instance. They further alleged that said remarks are calculated to bring the judiciary and the members of the judiciary into disrepute.

The petitioners further maintained that remarks made by MP Sanath Nishantha are calculated to undermine public confidence in the judiciary.

The petitioners are further seeking an order to punish parliamentarian Sanath Nishantha for committing the offence of Contempt of Court under and in terms of Article 105(3) of the Constitution. This application had been filed through Attorney-at-law Manjula Balasooriya. (Lakmal Sooriyagoda)

    Every judge who makes a judgment in this country and the entire judiciary has to live with being criticized. Judges are not gods. There are just as many assholes among them as there are in the rest of the population. In any case, the constitutional right to free speech ranks higher than the outdated colonial-era law on contempt of court.

    All unruly, unscrupulous, unqualified people are elected by the citizens. This is purely due to political illiteracy of the majority of the citizens. It has already paved the way for the present crisis in Srilanka. It is apparent that power greedy same bunch will take the country in the precipice further. Remember this country is full of resources and what need is a good system and pragmatic

    We all agree our judiciary is in the dumps. Ranjan Ramanayake was in prison for a similar offence and it's up to the judiciary to prove we live in a one law/one country system. Time will tell.

    The country the parliament and the judiciary has gone to the dogs. Sanath Nishantha is a thug, Ranil appoints him as a state minister by doing so the president of the country approves criminals to be in authority, therefore the Ranil himself proves to be an asshole too.(which is common knowledge anyway) If Ranjan was given a prison sentence then judiciary is bound to enact the same law that dealt with Ramanayke for this bastard too. Let's see what the rule of law in Sri Lanka is..
