The Colombo Chief Magistrate's court today ordered to dismiss a private plaint filed against former Central Bank Governor Ajith Nivard Cabraal.
Colombo Additional Magistrate Harshana Kekunawala made this order taking into consideration the preliminary objections raised on behalf of the former Central Bank Governor.
Former Southern Province Governor Rajith Keerthi Thennakoon had filed a private plaint in terms of section 136(1)(a) of the Code of Criminal Procedure Act seeking legal action against Cabraal for committing alleged offences while he was serving as the Governor of the Central Bank of Sri Lanka.
President’s Counsel Sampath Mendis appearing for Ajith Nivard Cabraal had raised preliminary objections challenging the maintainability of the plaint on the grounds of insufficient evidence to support the allegations and concealing material facts to effect that a petition filed over similar allegations has been dismissed by the Court of Appeal.
In this case, petitioner Keerthi Thennakoon alleged that Cabraal is responsible for the country's crippling economic crisis since he took measures to pay a 500 million US dollar sovereign bond.
President's Counsel Maithri Gunaratne with counsel Iresh Seneviratne, Ashan Nanayakkara and Migara Gunaratne appeared for the petitioner. (Lakmal Sooriyagoda)
