Claiming that more than 400 properties of small and medium-scale industrialists have been seized under the Parate execution law within the first four months of 2023, Opposition Leader Sajith Premadasa urged the government to suspend the Parate execution law considering the economic situation in the country.
Speaking during the adjournment debate on issues faced by small and medium-scale industrialists, he told Parliament that small and medium-scale enterprises are facing a huge crisis today.
"The parate law, which has a history of 30 years, should be amended to suit the modern era," he said.
Premadasa also said leasing companies were illegally seizing vehicles with defaulted leasing installments and added that it was an obstacle to the SMEs.
"The industrialists should be provided with some relief," he said.
Chief Opposition Whip Lakshman Kiriella said the Central Bank could issue a circular to suspend the Parate law without amending the law which would take time.
"The Central Bank has issued such circulars in the past where parate law was suspended by the CB for six months to small and medium scale rice millers through a circular. If the government really wanted to protect the SMEs, they could do it," he said.
State Minister of Finance Shehan Semasinghe said the government was looking into the matter and added that it should be done in consultation with commercial banks along with the Central Bank.(Ajith Siriwardana and Yohan Perera)

Parate law must be applied to recover money loaned. Recently Peoples Bank wiped out 50 Billion, loans given to businessmen without taking steps to seize their assets if they did not provide any collaterals. Bank officers who authorised these loans without a collateral must be taken to task

The SME are the back bone of our country's business sector.Look at the taxes paid by them and grant them relief so again they will be a vibrant part of our society.

Protecting SME's by waiving the Parate Law is not a solution. Some of the SME's and clients who obtain leases on vehicles are clients who have not done a due diligence of their capability in repaying the loan taken. At the time of obtaining the facility they will go to any extent to provide any security requested by Banks. In SME's we see that when they have to provide the audited accounts of their organisation they get these accounts concocted by dressing the balance sheets to show a healthy organisation. Lease facilities are given on the understanding that absolute ownership is given to the Bank or lease company until the repayment of the facility. The general public must understand that these facilities are afforded on the deposits of customers who have to be paid an interest on these amounts depending on the period of funds held with Banks and Leasing Companies. If defaulted facilities are accounted from the funds of deposit customers it will be unfair and not prudent .
