Cabinet Spokesman Keheliya Rambukwella today said that Parliament was not bound by Supreme Court interpretations and that the government might not agree with the Supreme Court ruling regarding the constitutionality of the Parliamentary Select Committee (PSC).
Addressing the cabinet media briefing Minister Rambukwella said under the ruling given by Anura Bandaranaike, the Parliament ruled supreme and therefore was not bound by the rulings of the Supreme Court.
Mr. Rambukwella explained that both the current speaker and the previous speaker had been clear on that fact. “The fact that the Supreme Court was the sole authority which could interpret the constitution was now debated,” he said.
Responding to a query whether the non acceptance of such interpretations would amount to a violation of the Constitution which specifically states that the Supreme Court was the sole authority to interpret the Constitution, Minister Ramukbukwella said the Constitution at no point bound parliament to such interpretations.
“Is there any place in the Constitution or the standing order which states that Parliament is bound by accepting such interpretations?,” he asked.
Minister Rambukwella said interpretations were mere interpretations and were traditionally accepted by parliament except by Speaker Anura Bandaranaike who rejected an interpretation as the parliament was not bound by such interpretations.
However, he said that parliament would not act in an unconstitutional manner. “The opposition has not said that we have violated the Constitution,” he said. (Hafeel Farisz)

Tthe spokesperson does not seem to be aware of the Rules of Interpretation. and the doctrine of the Seperation of Powers. The spokesman also does not seem to be aware of Article 125(1) of the Constitution which gives the Supreme Court the sole and exclusive jurisdiction to hear and determine any question relating to the interpretation of the Constitution and thereby Parliament also is bound by such provision.

Yes minister, people also will say in the future that they are not bound by the interpretations and orders of the judiciary just like their leaders. Then only the real drama will unfold.

According to the constitution all citizens are under the law, except the precedent. Parliament is not above the law. Parliament must obey the constitution and the law. That is the democracy.

The Parlimentarians are not a super aliens who have come down from some other planet witth special powers. They are voted by people of this country who have the soverignity and sent to the Parliament as their servants and representatives. If people do not appoint them then they are not Parlimentarians. If those who appoint them are under the jurisdiction of the courts of this country, how can their servants and representatives appointed by them are not? The Minister has forgotten from where he came, who really he is and who sent him to the Parliament.

zuhry Ahmed Friday, 21 December 2012 11:46 AM
If parliament is not bounded by the interpretation of the constitution, why parliament send the bills for checking the constitutionality to supreme court. People in the country know about the constitutionality more than parliamentarian. Why there is no standing order for probing the misconduct of parliamentarians who are supposed to be the supreme body. We know standing orders are not the country's rule that is only for the parliamentarians. N

Hon. Minister you are making a fool out of you. You say Parliament never act unconstitutionally. Fine, Hon. Ministers, Wimal Weerawansa and Dilan Perera insulted CJ by using derogatory words during PSC inquiry which was witnessed by Opposition PSC members and CJ,s Lawyers. Was it constitutional ? Please minister, if you cannot talk to the point, Please give up your Media portforlio. On the other hand, you are asking, anywhere in the constitution, is it stated that Parliament is bound by Supreme Court. Can you show in the constitution, it is stated that statements of late Anura Bandaranayake and Opposition go beyond Supreme Court ruling. Pl. do not talk nonsence.

Keheliya is either a dumb moron, or he thinks a majority of Sri Lankans are dumb morons, for making such a ridiculous public statement. 1. Parliament has to operate under the constitution. 2. Separation of powers exist to try to avoid, situations like the current dictatorial govt, and "Law unto Themselves" acts such as this 3. If he says parliament is not bound by the constitution, who else is to stop the thugs in the parliament doing what they like. 4 If parliament does not want to be bound by the constitution they have to get the 2/3rd vote to change it. If they can't then they must follow it (It's called a democracy Keheliya) .. contd..

contd.. 5. This is not rocket science, every decent democracy in the world has separation of powers Executive, Legislative, & Judiciary, where the legislative body is bound by the constitution, and if in violation, the judiciary steps in to ensure the supreme law of the land is not broken.
But then again, Keheliya is probably right the operative phrase being Decent Democracy, which SL is certainly not. Let me leave you with one quote… First they came for the Socialists, and I did not speak out-- Because I was not a Socialist. Then they came for the Trade Unionists, and I did not speak out-- Because I was not a Trade Unionist. Then they came for the Jews, and I did not speak out-- Because I was not a Jew. Then they came for me--and there was no one left to speak for me.

If the parliament had done a wrong thing, Citizen of this country should know who take action against it?..Is Army court superior to other courts and parliament?
37
Manushya Friday, 21 December 2012 02:28 AM
Although the parliament is a supreme body, you cannot hide behind such supremacy and do everything under the world. Everybody in their are not supreme either and your behaviour alone shows it very clearly . Although you are considered as "so called" legislators the laws made by you can only be interpreted by the Supreme courts. Whether like or not it is the bitter truth.
