Supreme Court dismisses SF’s FR petition

The Supreme Court today dismissed a Fundamental Rights petition filed by Capt. Senaka Haripriya de Silva, on behalf of Field Marshal Sarath Fonseka seeking his reinstatement to Parliament.

Capt. de Silva is the Private Secretary to Field Marshal Fonseka.

While dismissing the petition, the three-judge-bench, comprising Chief Justice K. Sripavan, Justice Rohini Marasinghe and Justice Eva Wanasundara, observed that there was no legal basis to proceed with the petition since it had been filed by a third person.

In this petition, petitioner Capt. de Silva had cited Secretary General of Parliament Dammika Dissanayake, Elections Commissioner Mahinda Deshapriya, Parliamentarian Jayantha Ketagoda and five others as respondents. (Lakmal Sooriyagoda)

Even if it was made by SF the results would not have changed. SF had no legal ground as by the conviction he lost his seat.One who had aspirations to be the president should have acted more prudently

It high time SF took a back seat and bask in his glory as a Field Marshall. Sri Lanka does not encourage militarypersonell in parliament. Want to enter politics,then give up your military high ranking position,become a layman first and stand for fresh election.

When Eisenhower became President he gave up his rank as a Five Star General, the highest position in the US Army. Why not Sarath do the same..
