Responding to LSSP call for prorogation of the Parliament in order to resolve the problems pertaining to the impeachment of Chief Justice Shirani Bandaranayake, government minister Dr. Rajitha Senaratne today said there was no such necessity for a prorogation.
The Minister also suggested that the existing procedures pertaining to the impeachment of Chief Justice could be changed later while the existing procedures should be used to impeach the current Chief Justice Shirani Bandaranayke.
Senior Minister and LSSP leader Tissa Vithara was reported saying that the crisis could be resolved by proroguing Parliament as it is possible to change the procedures and then bring a new impeachment motion.
However Dr. Senaratne who was also a member of the Parliamentary Select Committee appointed to probe the impeachment motion against Chief Justice Shjirani Bandaranayake told a news conference that there was no necessity to prorogue Parliament.
He therefore said the House should be convened -not prorogue -in an emergency situation.
“It is the legislature which is convened in an emergency situation instead of the Supreme Court,” he said. At the same time he said there was no crisis with regard to the impeachment motion.
Also Dr. Senaratne said the Appeal Court couldn’t issue notice on Select Committee members as the Committee was no more as a probe on the charges against the Chief Justice was no more.
“The Select Committee becomes defunct when it hands over its report to Speaker,” he said.
Besides he said those who criticize the Parliament could be brought before the Privilege Committee.(Yohan Perera)
