HC notice on plea against LTTE ban

The Madras High Court on Monday ordered notice on a public interest writ plea from MDMK leader Vaiko to quash an order dated May 14 last year of the Unlawful Activities (Prevention) Tribunal in New Delhi, banning LTTE in India for two more years.

The first bench comprising Acting Chief Justice Elipe Dharma Rao and Justice Aruna Jagadeesan ordered the notice, returnable in four weeks.

According to Vaiko, he had challenged an order of the Tribunal passed in November, 2010. The matter was pending. After the expiry of the two year period, the tribunal on May 14 last year passed a similar order banning the LTTE.

Petitioner contended that the order was passed under Sec 3(1) of the Unlawful Activities (Prevention) Act, only on the filing of reports and affidavits before the Tribunal, all relating to the criminal cases filed against certain persons, who were not members of the LTTE.
