British tourist tattoo case reserved for order

The Supreme Court yesterday reserved its order on a Fundamental Rights Petition filed by British tourist Naomi Coleman challenging the infringement of her fundamental rights when she was arrested and detained for allegedly displaying a Buddha tattoo on her upper limb at Katunayake last year.

In her petition, the British tourist had sought a compensation of Rs. 10 million and further sought a declaration that her detention was null and void and contrary to Articles 13(2) and 12 of the constitution. 

Supreme Court three-judge-bench comprising Justices Chandra Ekanayake, Priyasath Dep and Anil Gunaratne further directed that the parties in the petition that written submission be submitted to court within one month period.

The petitioner Naomi Coleman (37) a nurse by profession at the Hawkesbury Lodge, Rehabilitation Mental Health Services had filed this petition through Senior Counsel J.C. Weliamuna, Pulasthi Hewamanne, Thishya Weragoda and Hafeel Farisz on the instructions of Vishwa De Livera Tennakoon as a Public Interest Litigation. 

Additional Solicitor General Jayantha Jayasundara with Deputy Solicitor General Parinda Ranasinghe represented the Police officers. (Lakmal Sooriyagoda)
