Dy. Speaker says don’t respond to CA notice



Parliament will take action against members of the Parliamentary Select Committee that probed the charges against  Chief Justice Shirani Bandaranayake if they appear before the Court of Appeal to give evidence in the case, said Deputy Speaker Chandima Weerakkody yesterday.

JVP MP Vijitha Herath and TNA leader R. Sampanthan have announced that they will appear before court today.

The deputy speaker told Daily Mirror that the Select Committee members could not do so without parliamentary approval. He said that such an act would violate Article 4c of the Constitution and Section 17 of the Parliamentary Powers and Privileges Act.

“If they do it, a censure motion could be brought against them to condemn their acts in Parliament. Any member can move such a resolution and have it adopted,” he said.

A vote of censure expresses disapproval of or a reprimand on the member. The purpose of such a motion is to question or bring to notice a member’s responsibilities. However, a member does not lose his membership in such an event. In 1981, a censure motion was brought against the Leader of the Opposition on the grounds that he had advocated the creation of a separate state within Sri Lanka. (Kelum Bandara)
