CA dismisses Shashindra’s petition

The Court of Appeal today upheld two preliminary objections and dismissed the Writ Application filed by former Uva Province Chief Minister Shashindra Kumara Rajapaksa (UPFA) challenging his removal from office as Chief Minister.

The Bench comprised Justices Vijith Malalgoda (President) and H.C.J.Madawala.

Petitioner in his Writ Application sought an declaration from the Court that the 21st Respondent Harin Fernando (UNP) was not entitled to be appointed to and/or hold the office of the Chief Minister of the Uva Province.

He also sought the Court to quash the decision of the former Governor of the Uva Province informing him that the Harin Fernando was sworn in as Chief Minister of the Province on January 13.

Petitioner sought another order from the Court to direct the Governor of the Province to re-appoint him as the Chief Minister.

Manohara de Silva PC appeared for the Petitioner. Ronald Perera PC with Nalin Amarajeewa appeared for Harin Fernando and two UNP Provincial Councilors while Riad Ameen instructed by Gowry Shangary Thavarasha appeared for another two UNP Councilors. (Lakmal Sooriyagoda, S.S.Selvanayagam)

How do you know? Look at the reason: "the petitioner had failed to produce a Gazette notification relevant to the appointment of Mr. Fernando."Gazette notification can be obtained easily from the Govt Press! I am sure the judge was helpless!
