Colombo, July 28 (Daily Mirror) - The Attorney General informed the Supreme Court yesterday that authorities have obtained a red warrant for the arrest of Jude Shamantha Jayamaha, who was sentenced to death in connection with the Royal Park murder case.

State Counsel who appeared for the Attorney General, made this revelation when a Fundamental Rights petition challenging former President Sirisena’s decision to grant a Presidential pardon to Jude Shamantha Jayamaha was called before the Supreme Court. The petition was taken up before the Supreme Court to evaluate the progress of implementing the court order.

On June 6, 2024, the Supreme Court ruled that former President Maithripala Sirisena's decision to grant a Presidential pardon to Royal Park murder convict Don Shamantha Jude Anthony Jayamaha was arbitrary and invalid in law. The Court further directed the Attorney General and all relevant authorities to take the necessary steps to arrange Jayamaha’s extradition, as he is considered a convict on death row.

President's Counsel Sanjeeva Jayawardena with Counsel Rukshan Senadheera appeared for the petitioner. Saliya Peiris PC appeared for the Bar Association of Sri Lanka.

The judiciary of the country should be respected if Jude is trying to claim that he is reformed. Incarceration from society is what the rule book stipulates. At the same time, although he is a convicted criminal, he should be treated humanely. Reading his open letter, he claims that it has not been so.

A Presidential pardon once granted cannot be revoked due to the actions or perceived ineptitude of the Attorney General or other officials. The power to pardon is an executive prerogative and the Presidential decision once made is usually final. My question is why did it take so long approximately 7 years for the legal authorities to come into the realization that this pardon was wrong. Look at this case two Presidents followed after this pardon and they too never felt that this matter should be reviewed and there were no major changes in the judicial fraternity. On the surface it seems some conspiracy by the present rulers. When a Presidential pardon is given it constitues absolute and not subject to judicial review according to the US Constitution. It is the first time in the history of Sri Lanka a presidential pardon calls for revocation and a Red notice cannot be implemented overruling the Presidential pardon. The Bar Association should intervene and interpret the law!!!!!!
