No legal barrier in bringing motion to remove Deshabandu as IGP: Justice Minister

Colombo, April 1 (Daily Mirror) - Justice Minister Harshana Nanayakkara said there is no legal barrier in bringing a motion to remove suspended IGP Deshabandu Tennakoon from the office of IGP as claimed by former Justice Minister Wijeyadasa Rajapakshe.

He told a television interview that the Supreme Court has issued an interim order restraining Deshabandu Tennakoon from functioning as the Inspector General of Police and pointed out that the Supreme Court has given such a ruling as Tennakoon is still the IGP.

The Minister said therefore, the argument of Wijeyadasa Rajapakshe that Tennakoon is not the IGP is proved wrong.

He said Fundamental Rights petitions have been filed challenging the appointment of Deshabandu Tennakoon as the IGP and that the motion was submitted against his misconduct.

The Minister said the motion is not subjudice as the interim order is regarding the appointment of the IGP and that the NPP's motion is regarding the misconduct of the IGP.

He said the NPP's decision is 100 percent correct and that the Speaker has not undermined the powers of Parliament as claimed by Wijeyadasa Rajapakshe.

Promises are given to complete in 5 years only 5 months passed and even in this 5 months some of the promises given have been fulfilled. President promised to give some financial benefits for low income families and to keep the promise ,such families were given Rs 6000 for school books and free shoe vouchers , they curtail the unreasonable facilities of MPs and ministries.in my memory no government had done such work for the benefit of the community during a short time of governance.

(1) The action before the Supreme Court is to determine whether the individual concerned had been “duly appointed” according to the strict letter of the law, both procedurally and substantively. If found NOT SO, then he shall be deemed NEVER to have been the IGP of Sri Lanka! (2) The action before Parliament, however, seeks to “find” his actions as the “duly appointed” IGP in breach of the people’s reposed confidence/trust. Hence, when eventually proclaimed so by Parliament’s majority vote, he shall be deemed to have breached the public’s trust in no less a capacity than the “duly appointed” IGP of Sri Lanka! Why institute Parliamentary proceedings to “sack” him from “office” at a time when proceedings to declare his very appointment to such “office” ab initio void are still pending?
