Government to establish Independent Prosecutor’s Office

Colombo, Feb 10 (Daily Mirror) - The Ministry of Justice and National Integration has decided to establish an Independent Prosecutor’s Office as stated in the election manifesto of the National People’s Power (NPP).

The Ministry said in a statement that an expert committee is expected to be appointed as the initial step, which includes the Attorney General or two representatives from the Attorney General’s Department, the Secretary to the Ministry of Justice, a senior judge with expertise in the relevant field and the President of the Bar Association of Sri Lanka (BASL) or a nominee of the BASL President.

The committee will draft the concept paper on establishing the Independent Prosecutor’s Office and the Ministry will seek public and civil consultations after the concept paper is drafted.

There are many honest and hard working officers in the AG’s office. There may be cultural and hierarchical issues. Also, poor police reports and excessive workload, shortage of staff etc are impediments, so a new DPP office will take some of the burden off AG.

Lol. Instead speed up the process of hearing cases by providing modern technology to officials and also draft laws using parliament so that lawyers or judges cannot drag on cases as law clearly states. For example look into land and rental issues. Still these are getting dragged on ununnecessarily.

Justice minister says there are 1.1million cases pending. This is accumulation over the years and takes time to plan and solve. The poor state of the nation is sending good lawyers abroad. Not only technology but infrastructure like buildings are also needed for judges to operate. Ridiculous to expect these things to happen overnight.

AG's role is to represent / appear for the State and shall not have undue authority to influence the Judiciary. Accordingly, BASL representation in the proposed arrangement will nullify the influence the maintanance of a "level playground"

Whatever new system is being proposed regarding prosecutions in Sri Lanka the basis has to be the decisions about prosecutions should be the prerogative of the prosecuting Lawyers and not the Police. The present Sri Lankan system of the Police,who have no sufficient knowledge in law, having the power to prosecute is totally unsatisfactory. This change will help regarding fairness in prosecutions and cut down on police corruption.

To me the proposal sounds a bit awkward. As per the existing laws AG is the independant prosecutor. Many laws will need to be amended. If it is named independant Prosecutor, then the new institution must do all criminal prosecutions leaving the AG with civil work

"Independent Prosecutor's office?" Independent from whom? The path to this official has obstacles put by RULERS and their henchmen is the fact. In other words, it is our politicians and their henchmen who bring disrepute the legal system in this nation. It is these politicians who mess around with the police and cause immense delay in finding quick justice. Do we have the courage to admit this? Look at the cases that are being dug out these days from graves!
