Colombo, April 13 (Daily Mirror)- The Bar Association of Sri Lanka (BASL) has called for swift and transparent action over the alleged assault of a young man by officers of the Medawachchiya Police Traffic Division.
The alleged brutal police attack on the young man resulted in the surgical removal of one of his testicles at the Anuradhapura Teaching Hospital on April 9.
In a statement, the BASL observed that the perpetrators must be held accountable to the fullest extent of the law.
The BASL vehemently condemns any use of brutality by police officers carrying out their official duties.
"We underscore the obligations enshrined in the International Covenant on Civil and Political Rights (ICCPR), which unequivocally prohibits torture or any form of cruel, inhuman or degrading treatment or punishment. Such actions also stand in stark violation of Article 11 of our Constitution, which guarantees freedom from torture or cruel, inhuman or degrading treatment or punishment," the BASL statement added.
The BASL further stated that it will be closely monitoring this case and urges the authorities to take all necessary legal measures to ensure such heinous acts are not repeated.
Referring the judgment of the Supreme Court in Sudath Silva v. Kodituwakku reported in [1987] 2 Sri LR 119, the BASL stated that every citizen, regardless of background, is entitled to the full protection of the Constitution.

Hats off to the Bar Association. It's people's luck to have an association like yours to protect people's rights against certain hooligan uniformed staff. Shame to DIG Police Spokesman who mentioned that the injury was due to falling on the vehicle gear arm.... People expect the new government who will be appointed in another 186 days to look into all the atrocities and make the maximum punishment and irradicate all the brutalities in our country.

Thanks BASL. This must be counted under all possible categories including human rights, gender based violence or sexual abuse.

There is no use talking about it under this Govt. A public-spirited Lawyer should teach the police fellow a good lesson.
Deterrent Sentences Needed Sunday, 14 April 2024 11:13 AM
Correct, all those injustices caused by these current morons must be dealt with swiftly and harshly. If not this will be the norm for people with authority. After serving their sentences, either the employment is terminated or a reduction of pay for the next 10 years with pension removed. Need to send a deterrent sentencing these fellas who think they are above the law at all times.

Where is constitution stading right here in Sri Lanka? under the US command and hegemony, rejected person Ranil holding president of Sri Lanka, a proof a well founded grave violation of constitution than anything else in the history of Sri Lankan political arena.

BASL Please don't be NATO. (No Action Talk Only) Show by deed. Case cited is a FR case where the Leader of the Bar at the time HL de Silva stepped in to argue and succeeded. Likewise without monitoring please show by deed

The BASL has done what is expected of them, but must follow up with legal action against the police. People are helpless, they need more awareness of their rights. A lawsuit is a must to demand adequate compensation and appropriate punishment for the perpetrators of the crime.

Law is what Police Says. Our judicial system has failed to control abuses /excesses of Power by Police as well as by the Government . The final finding will be after a decade will be that, it is the victim who has voluntarily demasculate himself.

Imagine cops who r suppose to uphold law and order doing something like this. Our country needs a total rethink. We need to stop and start from independence again. BUT HOW?
