Commercial High Court issues interim injunctions against several Blue Ocean Group companies

Colombo, March 24 (Daily Mirror) - The Colombo Commercial High Court has issued several interim injunctions against Blue Ocean Legand Pvt Ltd, Blue Ocean Waves and Link Engineering, which are companies affiliated to the property developer Blue Ocean Group. 

In an action filed by Horton Realty Pvt Ltd, it was alleged that the Blue Ocean Group of Companies had agreed to transfer 13 apartment units of a condominium development situated at 19th Lane, Kolllupitiya pursuant to a master agreement signed between the said companies and Horton Realty for approximately Rs. 477.9 million, which contains debt set off by Blue Ocean Group, of a sum of Rs. 277 million and another sum of about Rs. 191 million in lieu of steel that was to be supplied by a company affiliated to the Blue Ocean Group of Companies named GTB Steel Pvt Ltd. It was submitted to court that the Blue Ocean Group has not abided by their contractual obligations and has threatened to dispose and or alienate the apartment units that they have agreed to transfer to the plaintiff. 

The Commercial High Court of Colombo (Court 2) having heard the parties issued interim injunctions preventing the defendant from cancelling or terminating the Master Agreement and terminating the Sale and Purchase agreement, further also preventing the alienation of the said apartment units. 

Faiszer Musthapha PC with Dayasiri Jayasekara, Shaheeda Barrie, Pulasthi Rupasinha and Sierra Amarasiri appeared for the plaintiff and Dr. Wijedasa Rajapaksha PC while Madava Jayawardane appeared for the 1st to 3rd defendant companies and Ikram Mohammed PC with Eranthi Abeywardane appeared for the 4th Defendant.
