Nihal Sri seems to forget that in all the other instances where non-judicial officers make determinations mentoned by him, there is an appeal process which is adjudicated by the judiciary.

The question is about a fair trial. If any other officer is not satisfied with the decision s/he could appeal in courts in front of an independent judge/jury. Fair trial should be right of any citizen. You cannot assume Parliament to be a jury since it is politically motivated and it does not represent individual opinions. For example, if you're in the government you're inclined to vote in favour of impeachment even if your concience says otherwise.
