Former OIC acquitted of forgery charges after 19 years

The Colombo High Court today acquitted and discharged the former OIC of Sri Lanka Police Reserve Headquarters Vijith Weerasinghe from all the charges relating to a forgery incident that took place in 2004.

The former OIC was indicted in the High Court for allegedly preparing forged documents to reinstate Reserve Police Constable Marikkar Kabeer who was sent on compulsory leave as he had secured employment abroad. 

The Police Constable Kabeer giving evidence stated that he appealed to the Inspector General of Police and Commandant of Sri Lanka Police Reserve Headquarters that he be reinstated soon after he returned to Sri Lanka after his foreign employment and he has had no contacts whatsoever with the accused. 

The witness further said he had never seen the accused before he came to court. The Examiner of Questioned Documents of the Government Analyst's Department Jayasundara giving evidence stated that he is unable to express any opinion with regard to the signatures of the questioned documents as the investigating officers did not seek the signature of the accused to be compared with the signatures of the questioned documents.

Having considered the evidence led by the prosecution, High Court judge Amal Ranaraja decided to acquit and discharge the accused without calling defence evidence as there is no prima facie case against the accused. 

Senior Counsel Darshana Kuruppu with Counsel Sudarsha De Silva appeared for the accused. (Lakmal Sooriyagoda)

    19 years to solve a case. Guess the amount of money earned by the lawyers. Why imf never ever suggest or force governments to do anything about these massive delays in judicial system to save money and time. They too want to let countries like us continue in debt and help the corrupted politicians. At least a system should come in to effect where lawyers cannot charge when case get dragged on and if they collect any payment from client. They will loose the license

    This is exactly what we citizens pending court cases face. 80% of the time hearings are cancelled, we loose track of when the next date is. Of course the lawyers being the worst professionals, among any degree holders wont have a clue other than turning up to the courts and asking for extensions and of course their fees for doing nothing. High time courts are forced to maintain electronic records. An absolute pathetic state of affairs.

    One more from Sri Lanka for the Guinness records. When the signatures was missing the case should have been thrown out on the first appearance. It has dragged on for 19 years wasting the time and money of lawyers, judges and everyone involved. What a waste of resources. How could this country progress..with this type of corruption and inefficiency.

    I don't know whether to laugh or cry at the silly evidence given by the EQD. If he did not examine the signature, what did he examine in the document? Spelling mistakes or grammar? The fellow should be dismissed for incompetence, or worse.
