Former Army Commander Sarath Fonseka lashed out at those in command in the Army for the alleged inaction to arrest the culprits involved in the assault on an Army intelligence officer.
“We heard that the military is trying to take action against this officer who was an innocent man assaulted by the thugs. The Generals in command are showing their cowardice by trying to take action against the army officer before the Police take action against the culprit,” he said.
Mr. Fonseka said if an incident of this nature had occurred during his tenure in the Army he would have ensured that the culprits were arrested.
“Fortunately we were professional officers and nobody would go down to the level of treating any officer or soldier like this. I would have definitely ensured that legal action is taken against the culprits and I would have gone to any extent to do this. If I was the Army Commander I would have ensured that Malaka Silva was arrested,” he said adding that there was an attempt to cover up the incident right from the beginning.
“We have information to say that when the Army Major who was injured was admitted to hospital the Director of the National Hospital had tried his utmost to discharge the Major without treatment but the doctors had refused to do so,” he said.
The former presidential candidate and leader of the Democratic Party said this wasn’t the first time that the law did not take its normal course.
“This isn’t the first time similar things have happened sons of government politicians have continued to misbehave and there was no proper action taken against them. There is a minister and also a man in charge of the law enforcement authorities in the country. He seems to be deaf and blind and this is a very pathetic situation. I don’t think this type of thing would happen in any civilized country. It happens in this country because the culprits are being looked after by powerful politicians. There is no action taken against them and therefore there is no place for people to go seeking redress,” he said.
Responding to statements made by Minister Mervyn Silva who reportedly said that Fonseka had to hand over his son in law first to the Police prior to calling for the arrest of Malaka Silva, the former Army Commander said his son-in-law would face the court of law when the law applies equally and judiciously to all citizens.
“My son in law is not with us and we don’t know where he is. This man Malaka Silva is out in the open and even went to the Kelaniya temple with his father who is a minister. My son in law is in hiding for three years because during the presidential election my opponents planned to arrest him on bogus charges and kill him. He will come out when there is law and order in this country,” he said. (Hafeel Farisz)

Well said General Fonseka. it is basic facts. If the CCTV footage of Hilton Residence, on the day of the incident is telecast, the public would have known the true story of it. Why is it not been shown to the public. the Army shuld have acted long ago.

There is no argument that this thug called Malaka should be arreseted so that the due process of law can be applied irrespective of what his father says that they have a different story to tell. This is for the police to investigate, and not for Mervyn Silva or Sarath Fonseka to judge.
I cannot tthough agree with one of SF's statements, that his son-in-law will surrender when the law and order situaution in SL improves or stabilises; then Malaka can use the same argument and stay in hiding ( or decide to loaf around !).SF's son-in-law .has a law suit against him in the Supreme Court (?) and there is an International Arrest Warrant against him. If there is a threat to his life, he can surrender through his Lawyers. But again this is upto the Courts to decide and not anyone else and that include both SF and his Son-in law.

The crux of the matter is that POLICE have failed MISERABLY to arrest Malaka Silva a wanted person for an alleged assault on two public servants on duty or purported to be on duty WHEN HE APPEARED AT THE kELANIYA TEMPLE.
Either the police on duty should have arrested Malaka Silva or should have detained him at the Temple Police Post and notified Slave Island Police.
Neither has been done.
IGP need to notify the public what action he intend to take against all Police Officers who were on duty there when Malaka arrived at the temple..... Police Ordinance has wide powers and the Police failed to act.
If & would, will & buts are not relevant here.
POLICE HAVE FAILED & MILITARY INTEL IS ASLEEP.

What is he telling. This has happened at a Club. No body knows he is an Army Officer. So we can't say this has happened to a Ranaviruwa. But generally this type of things shroud not be happened. But we must not take any political advantage from this.
And we as people of the country should appeal to Dr. Mervyn Silva & Gen. Sarath Fonseka, Both to produce their sons to the Police for inquiries.

But was very fast to recognize the poor soldier who toiled on his own to bring honour to the country. The Major would have been one in the midst of flying bullets risking life and limb for us to live. So, c'mon Mr. President, crack the whip even now and put the culprit in prison!!

General its useless saying anything. This guy Malaka is out in the open and will never be prosecuted in a court of law, at least his father will see to it that he is not.
The hierarchy in the Army should take steps to protect their officers and soldiers, who have valiantly fought a battle and won it,leaving us citizens to walk the roads of this country fearless. However, the local thugs seem to be having a wonderful time wielding on the lofts of their shadowed powers, so to speak. It was reported that a statement was made that "My son would never assault an army officer or soldier, but he would assault a man" Now isn't this silly. Would this army officer have been in his uniform and all military garb when he went to the Hotel? no I do not think so. Then he would fall into the category of a "Man", as put by this statement. Of course poor little sonny boy would not have known that behind this figure of a "man" was an Army Major!! Tck Tck poor little boy.

Under the new commander, the army has become a weak entity pandering to the wishes of the politicians. Nothing will happen in this case too as were the other various incidents involving both Mervyn and his son. The million dollar question is : "Who is Afraid of doctor Maravin"? and Why? Answer to that would help in solving a lot of crimes in this country!
