Resignation of Mullaitivu Magistrate:

NPP demands transparent truth-seeking investigation

The National People's Power (NPP) urged the government to conduct a transparent truth-seeking investigation into the resignation of Mullaitivu Magistrate T. Saravanarajah.

Speaking at the Polonnaruwa District Convention of the Retired Tri-Forces Forum, NPP Leader Anura Kumara Dissanayake said if the claims made by the Magistrate that he had death threats and therefore left the country were true, it is a serious situation.

"If the claims made by the Magistrate are true, where are we as a country? If a magistrate has to face death threats just because he gave a ruling that is not partial to the government, it is a serious situation. If the claims made by the Magistrate are not true, an investigation should be conducted to ascertain the conspiracy behind it," he said.(Ajith Siriwardana)

    People seek justice through ompartial judicial proceedings and leaing to a final verdict from those presiding over the courts and if it is not achievable, the whole purpose of rule of law is lost and this resignation is a very bad precedent to an impending anarchy which would only to please the government.

    I would respect the JVP a lot more if they just stopped using the word conspiracy so v much. This is plainly a case of a judge being forced to flee in fear of his life by the racist elements.     Powerful politicians must leave the judiciary alone and non-interference. There is no way in a decent country can threaten a judge to give biased verdict. There were many occasions where biased judgements were given in law courts due to political pressure. Therefore the world will not and cannot accept local probe in the Easter Sunday bombing or the the civil war that ended in 2009. The country must go for an international probe for both.

    If one wants to get the bottom of this saga the following should be the terms of reference of the fact-finding mission: i. At least one member of a foreign independent organisation such as UN or Human Rights Group should be a representative. He/ she should fearlessly be able to agree or disagree with any part of the investigation and put forth his/her views. ii. Preferably a member of the opposition party such as JVP should be one of the members in the hearing group. iii. The ex-magistrate should be provided with protection to give his observation without duress. iv. All observation of this select committee should be published and signed off by each member of the committee.
