Sri Lanka’s efforts to nab overseas criminals hit a snag

Colombo, Feb 9 (Daily Mirror) - Sri Lanka’s efforts to arrest organized criminals operating from overseas has hit a snag following the Court of Appeal in France ruling against the extradition of criminal called ‘Kudu Anju’, Daily Mirror learns.

The ruling has been communicated to the Sri Lankan authorities. However, a top official familiar with the process said the latest ruling conveyed on February 1, 2024 is not the final judgement.

“It is not the final judgement. The final ruling will be given after the judicial process is over in another couple of weeks’ time or so,” the official said.

In the meantime, the Sri Lankan Embassy in Paris is in communication with the French Foreign Affairs Ministry to get the ruling clarified further.

Earlier, Public Security Minister Tiran Alles said the government initiated a special operation to arrest 30 criminals involved in drug trafficking and criminal activities while living in countries such as the United Arab Emirates (UAE) and France.

That is in parallel with the Yukthiya operation which is currently in progress to control the organized criminal activities.

Asked for a comment in this regard, Minister Alles said the government would try various strategies to net all the criminals despite challenges but declined to elaborate on them.

    There is only one method to deal with drug dealers and the courts are not that method. The law offers these criminals de facto State protection. These criminals are the vermin of society and should be exterminated.

    Following up on Dinesh's great comment, it's funny how people like you, Gabriella, change your tune when you're the one accused, falsely or otherwise, of a crime. This is what morons like you don't understand: In civilized countries--read: not SL--the law is set up to (ideally) ensure max protection for innocent people, which necessarily means that everyone must have those rights and protections. Besides, when drugs are decriminalized and the root causes of addiction are addressed, we'll all be better off, but that's too civilized a thought for someone like you, I realize.

    Nothing will happen because we have a poor judiciary and security system. Suspects are treated according to Police and Political agendas, that is why we hear so many cases of police killing of suspects in their custody. Further, the judiciary and prisons are rife with corruption, where if the prisoner has money he can live a lavish life inside prison or even pay for his release. Western countries know that the Sri Lankan State itself is part of the reason for drugs.

Allegations were common that there's a risk that some criminals could be obliterated to disguise their associations with politicians. If that is the case the real culprits would never come to light...

    Without arresting, extraditing and prosecuting criminals and underworld figures operating from foreign soil, such activities cannot be eradicated and legal loopholes have to be addressed , especially in the case of the famous drug addict underworld figure-cum criminal who fled to India by boat despite heavy naval presence immediately after he was granted bail by our courts.

    The main reason for no extradition is that Sri Lanka does not have an extradition treaty with France. For another country, unless there is an extradition agreement, an arrest warrant via Interpol is just a polite request. The second reason for non-extradition is that EU countries are not allowed to extradite to countries that have the death penalty. Extradition is also prohibited if torture is to be expected. Especially since Sri Lanka's highest police officer has just been convicted of torture, this is proof that torture is happening in Sri Lanka. Sri Lanka should not bother other countries with these senseless extradition requests.

It is imperative that these alleged wrongdoers face elimination through a lawful judicial process, ensuring a fair trial and adherence to legal principles. Unfortunately, in our country, this desired standard of justice is not being consistently upheld.
