First application under Online Safety Act filed before Court

The first application under the newly enacted Online Safety Act was made to the Colombo Chief Magistrate’s Court and Court issued a conditional order preventing respondent parties from communicating alleged false information against former Chairman of the Public Utilities Commission (PUCSL) Janaka Ratnayake.

Colombo Chief Magistrate Prasanna Alwis issued a conditional order in favour of the Petitioner Janaka Ratnayake in terms of Section 24 (1) and Section 24 (2) of the Online Safety Act No. 09 of 2024 and directed that the order be communicated to the Respondents Gayathri Bimba, Janaka Rajapaksha, Oshala Herath and several others by electronic means as provided for in Section 24 (4) of the Act. 

In his application Janaka Ratnayake, alleged that respondents had circulated or is attempting to circulate private information. The Petitioner further alleged that he was a “targeted individual” and that one or more of the several Respondents named in the Petition were intentionally harassing the Petitioner by communicating false statements. 

President’s Counsel Kalinga Indatissa with Counsel Vishwa de Livera Tennekoon, Lilani Ganegama Neranjan Iriyagolla, Rashmini Indatissa, Naveen Jayamanne and Nirod de Silva instructed by Mithun Diasz appeared for the petitioner.

    This is very good , a lot of people, specially affiliated with NPP, have been spreading utter false information about many individuals. This has to stop and anyone accusing anyone else should be able to prove what they say as true. Otherwise people get always deceived

    What is your problem with the NPP? Have any of them ever pissed in your front yard? No matter what the topic, the NPP is always to blame. Why? I'm definitely not a supporter of these people, but things should always be looked at objectively and not one-sidedly. On the subject of online bills: Anyone who is in the public eye has to accept that they are reported in the media, whether it is correct or fake news. The people are not journalists and therefore not subject to the ethics of a journalist. However, many of these messages have exposed the crimes and improprieties of our corrupt politicians. If you waited for these messages until one of these Crooks was convicted, you could wait forever. By the way. You are also blaming the NPP here without providing any evidence.

    Tissa, I have always been in agreement with your comments but respectfully beg to differ in this instance. In Sri Lanka, we know very well who's done what although the evidence might only be circumstantial. Those who are intelligent and knowledgeable know what's true and what's untrue. Take Obama for example, he had and continues to be the target of misinformation of unimaginable proportions. He never let any of the lies effect him. And he remains one of America's most loved presidents.

They aim to earn money by endorsing furniture, undergarments, and even their baby's birthday cake, shamelessly turning everything into advertisements. This culture needs to be halted for numerous reasons, as it pertains to societal upbringing and social ethics. They seem to lack the understanding of shame. When shame is absent, these superficial individuals often transition into politics.
