Growing trend of MPs exploiting Parliamentary privileges: BASL

The Bar Association of Sri Lanka (BASL) announced that there is a growing trend of members of parliament exploiting parliamentary privileges by making statements in parliament, for matters which are sub judice (being considered by a court). 

In a statement, the BASL stated that it finds the recent statement by Parliamentarian Sarath Weerasekera in Parliament, on 07 July 2023 as an unfounded, brazen attack on the judiciary and the social fabric of the country. 

The BASL observed that the recent trend of pressure being exerted over the judiciary would potentially threaten and undermine these important principles. 

The BASL is of the view that the judiciary should be allowed to operate independently, free from external pressures, threats or any interferences, for a vibrant democracy to exist. 

The BASL further observed that it is the duty of the government and the Opposition to respect and observe the independence of the judiciary, and any interference in the judicial process sets a dangerous precedent, which must be strongly condemned. (Lakmal Sooriyagoda)

    Courts cannot interfere in parliamentary activities, especially since judges are now in effect tax evaders since they are no paying the due taxes since they have court case to perpetually delay paying taxes since increased taxes came into effect. Finance Minister will sooner or later have to start condemning the judiciary not paying taxes like everyone else in the country has to. Judges are not above the law of others. MPs during parliament session are free to criticise judges and the courts as much as they want. They can make whatever statements they feel, and also state they thoroughly respect the courts, but next sentence say but only if a list of MP made up problems do not exist.

    BASL only talks rubbish nothing more. What have you done so far to speed up existing land related cases which goes on for years, what have you done to modernize the courts to make it easier for people. Unless you make judiciary people friendly by forcing the parliament to make necessary changes, you are just making statements without any good for the people.

    BASL should stop its Laywers exploiting clients, with double booking and leaving everything for the last minute and then asking for dates. Court cases are being unduely dragged with half Ar*se jobs done by the lawyers. But they wont hold back on charging $$$$. I dont know any other professionals, who can afford to be unaccountable for their actions and hold clients as hostages; other than the lawyers mafia.

    Ranjan R mentioned, after his release, that his intention was to produce a large number of witnesses, including former President Sirisena, to substantiate his statement regarding corruption of the judiciary. According to him, this process was suddenly stopped halfway and he was imprisoned for defaming the judiciary. If true where is the honesty and independence of the judiciary???

    This is what happens when military officers are appointed as members of the parliament. They don't know about the decorum of parliamentary conduct and unleash activities to spearhead their election campaigns indirectly by abusing privileges. They thing if their names are decorated with military titles they are the true patriots but little they knew that they are the pseudo patriots. People are not going to elect any of those SLPP members under Rajapakses in the next election, so they using the parliament procedures is their political platform. Shame on the country for abusing Westminster system of democracy.
