The Indian Supreme Court on Monday issued notice to Centre on DMK chief M. Karunanidhi’s plea seeking direction to government to retrieve island of Katchatheevu which was given to Sri Lanka in 1974 and make it as part of Tamil Nadu.
Agreeing to hear the plea, a bench headed by Chief Justice Altamas Kabir sought response from the Centre.
Mr. Karunanidhi, in his petition, urged the apex court to declare the agreement between India and Sri Lanka reached on June 26 and 28, 1974 and the accord of March 23, 1976, for giving Katchatheevu to Sri Lanka, as void and unconstitutional.
The petition said that Centre be directed to take appropriate actions to restore the pre-existing historic rights of the fishermen of Tamil Nadu to fish in the waters surrounding the island.
“The issue involved in this writ petition is the unconstitutional ceding of the island of Katchatheevu by the Prime Minister of India to the Island nation of Sri Lanka, completely disregarding the constitutional provisions and totally ignoring the federal polity of our country which is an integral part of the basic structure of the Constitution,” the petition said.
Katchatheevu is an uninhabited island located about ten miles North East of Rameswaram on the Indian side and Nine miles of south of Delft Island on the Sri Lankan side. It has an area of 285.20 acres. (PTI)

the two issues don't mix up, besides with regards to the "stateless" are you talking of your forefathers-King Vijaya
What evidence does SL have to prove that it historically belonged to SL, India has relevant documents, that were used at the time of the ceding

Ceding Kachativeu to SL was a mutual agreement whereas the 13A was shoved on us under threat.

Do not arouse Sri lanka armed forces. They will crush any challenge to our territorial integrity But later please do not shout about human rights!

both PMs who signed the agreement are not alive now. At he time Kathaithivu was ceded Karunanithi was in power in Tamil Nadu. why did not he oppose the agreement then. This clearly shows that his petition is politically motivated. nothing else.

I thing you need to go to school. Territories are not measured by distances from a country. Otherwise India cant claim andaman & nicobar Islands and Briton can't claim Parkland.

Shaluka, this is not about sea water sharing, this is about the island which was ceded illegally and unconstitutionally by Indira Ghandhi, which until then belonged legally to India.
International laws would become applicable only if the ownership of an island is in dispute, here it is the legality of the transfer

Like our agreement on 13 amendment to the constitution the Katchatheevu agreement is also an International treaty.
One party can't reneged.

With the retaking threat of Kuchchativu island by India (in fact Kuchchativu is situated in Sri Lanka's maritime border), India expect majority voice of Sri Lankans to surrender their choice by gifting of (1) merging of North and East, (2) 1/3 of land from the Island to the merged province, (3) 2/3 of coastal area, (4) Police powers (5) Land power, etc. etc. All these privileges to please 13% Tamils despite majority of them living outside north and eastern provinces besides Tamil diaspora.

if SL can unilaterally cancel 13 , why can't India demand back Katchatheevau?? After all, it was donated by India in 1974 and now their fisherman are killed by navy and denied.
After all Indians are no fools!

Whatever said and done, Kachchathivu historially belonged to Sri Lanka : hence, the ceding of it by India to Sri Lanka does not arise. The agreement just sought to regularize the issue. This tiny island is nothing when compared with the fact that Sri Lanka has given citizenship to millions of Indians who were branded as "Stateless" by Mother India!

In the future it may extended furthermore and they might say that Sri Lanka was also part of India earlier and it is belongs to Tamilnadu. I cannot understand the motive of these people and believing of the humanity. Earlier these things was dictated people like Hitler and now those blood had been transfused to gentlemen like Vaiko, Karunanidhi and M/s Jayalalitha. May God save our nation from these elements.

Give and Take policy. Shame on you guys (india). India definitely doesn't want Pakistan on one side and SL on the other both fighting for land. India is fighting for land in all areas, later they might claim parts of nepal and Bangladesh.

you go back to school and learn history and geography in the first place, this island belongs to India it was ceeded to Sl only in 1974, that too unconstitutionally by Indira Ghandhi
Territorial sovereignty is not decided by the distance from the centre line

Their intentions would be to rob our rich fish harvest including mineral resources such as oil, gas, etc., if they retake Katchatheevu.
