Court suspends unauthorised production of novella ’Mai Maara Prasangaya’



Colombo, Dec. 5 (Daily Mirror) - The Colombo Commercial High Court issued several enjoining orders against several vendors and booksellers engaged in the unauthorised reproduction and public distribution of the novella 'Mai Maara Prasangaya' authored and published by popular novelist Mahinda Prasad Masimbula.

The plaintiff Masimbula sought an enjoining order to secure his economic rights as the author and publisher of the said book.

In making submissions, counsel for the plaintiff informed court that these cases were filed to secure the economic rights of the author under the Intellectual Property Act and that the defendants had been engaged in the sale of counterfeit copies to the public. 

Taking the facts into consideration, Colombo Commercial High Judge Amali Ranaweera issued enjoining orders against the defendants to be effective until December 10.

The court further issued the notice of injunction and summons to the defendants. The enjoining order can be conveyed to the

defendants over the phone by the registrar of this court, by email and by way of fiscal of this court.

The plaintiff has sought several reliefs in the cases filed, including the disclosure of the identity of the sellers of counterfeit copies of 'Mai Maara Prasangaya'.

 

The plaintiff was represented by counsel Buddhike Illangatillake, Vinura Kularatne and Chathuri Jayasuriya instructed by Attorney-at-Law Sanjay Fonseka.
