Two men fined for gross indecency

A Colombo Court today imposed a fine of Rs.1,500 each on two men who pleaded guilty to the charge of engaging in homosexual acts inside a public lavatory at the Fort Railway Station.

The Fort Police arrested the two men, one aged 40 and the other 50, while they were engaging in oral sex.

One of them was identified as a state institution employee.

In the charge sheet filed before Colombo Fort Magistrate Kanishka Wijeratne, the prosecutors said the suspects had committed a punishable offence which came under section 365 (A) of the Penal Code.

Police charged that the suspects had engaged in activities of gross indecency at a public lavatory.

Defence Counsel Jayantha Pathirana told Court that his clients would plead guilty to the charges. (Lakmal Sooriyagoda)

The railway department and the Cheif security officer and the Station master should be fined.
Coz they're not good enough to protect personnel privacy inside a public toilet and they're nor maintaining infrastructure of the toilets.

Always have been a problematic section in the penal code. According to this section any form of sex other than reproductive sex even between heterosexuals can be charged under the gross in decency concept. And of course in another sense its a blatant violation of gay rights and a bad precedent. Its time for this section to change !

The question is was this act consensual? Then the only crime here is that they did it in a public place. They should be charged for that and not for the act itself.
