Complaint withdrawn under duress-SF

Former Army Commander Sarath Fonseka charged that it was clear that the Army major who had complained that he had been assaulted by Malaka Silva withdrew his complaint under duress.

“This is another classic example of the situation prevailing in this country. The whole country, including the Army, know that this major was assaulted by these thugs. Now if it has come to a stage where the major has given an affidavit. It must have been done under duress. During the earlier stages of this incident it was known that when Malaka Silva wanted to return the pistol to him, he refused to take it. So now you can see what is happening in this country” he said.

Fonseka said that all military men were saddened by this turn of events.

“Everyone is very unhappy, officers down to the soldiers have spoken to us and they are very unhappy at the turn of events. Everybody knew that the culprit would get away and this would be the final outcome. The military is very unhappy. They want to see justice done by their comrades. Those people will be waiting for justice to be done one day” he said.

The former presidential candidate and leader of the Democratic Party said that it was not irregular for an Intelligence Corps officer to carry a pistol while off duty.

“On the other hand, when the Army appointed a court of inquiry to fix the major, to say that he was in the wrong place, that he was carrying a weapon in the wrong place, the only way out for the major is to say that the incident never took place. The Army has thus, indirectly put pressure on the major to withdraw his complaint. The major’s having a pistol with him when he was off duty was not irregular. Majors in the Military Intelligence Corps are permitted to carry their pistols even when they are off duty for their personal protection “he said.

Fonseka went on to state that those in power were “deaf and blind to crimes that take place in the country.”(Hafeel Farisz)

I totally agree with "kd". Just look at all of us! We are not even ready to give our real names. But the General is a known figure and is making public statements like the fearless man he was and is. Like I said once earlier, he is doing his darnedest best under the conditions of release, thrust upon him. May I ask, "will you take to the streets, Nodrog?"

As a soldier he is bound to follow orders from the top. As such only two choices were open to the Major, either swallow his pride and obey orders or resign with his his integrity intact. He has taken the path of least resistance.

I do not agree that he withdraw under duress , We should be impartial , Though Dr group is notorious , we should think other side as well .
1) Why the major was there , does he on the Job if not , from where he gets this much money to spend places like this .
2) A soldier can not be on duress , he must have settle the issue with lumpsum amount .
Further there is no reason that Malaka just hit the soldier , so he too must have behaved abnormally thinking of his star.

Okay DOT UNCLE, then answer these questions and make your conclusions.
1) With his salary could he have afforded to come to Jaic with some of his soldiers, unless it was on official business, which only the Army would know.
2) Is the Major such a dim wit to make public the incident, if he was doing something he would not have the Army hierarchy find out?
3) Isn't it similar to the health workers story which came out to exonerate the thug father after the infamous "Gas-Bandina" case in Kelaniya?
4) Are you actually impartial?

I don't blame the Major as he has to protect himself and his family from the government sponsored goons.
Most of them in the ruling party are a law unto themselves.
Murder, rape, arson, assault, commissions on contracts and various other malpractices are taking place like anyone's business.
"Wonder of Asia" in big letters at the stadiums is so true as no other nation in Asia is as corrupt as our wonderful nation!!!

Absoloutely true Sir. We already have a precedent of a government servant being tied to a tree by the notorious Minister from Kelaniya and when it came to courts, he threatened the victim and got an affidavit to the effect the latter asked to be tied to a tree. So, this is just another repeat of the same old saga where the so called "doctor" acts with impunity Do we need further proof that the country has gone to the dogs.

You can see a starc difference in his speech when you compare him before and after he left govt ranks. What is clear is that this country will never enjoy rule of law at least in foreseeable future.
