Duminda will surrender on his return -Lawyer

Lawyers told the Colombo Magistrate today that MP Duminda Silva who is currently undergoing treatment abroad for injuries sustained at the Kolonnawa shootout will surrender, once he returns to the country after his recovery.

Silva’s lawyer said this in objection to an Interpol warrant sought by Counsel for slain Baratha Premachandra’s family to arrest Duminda Silva.

Counsel Hemantha Warnakulasuriya informed the magistrate that a warrant was not necessary, as his client Duminda Silva would surrender to court if the case still in progress by the time he arrived in Sri Lanka.

Silva’s counsel informed Court yesterday his client had to undergo another surgery at Singapore’s Mount Elizabeth Hospital and would appear in Court at the end of this month based on the recommendation of his doctor.

President’s Counsel Hemantha Warnakulasuriya told Colombo Acting Magistrate Mr. Silva was keen to attend court and prove that he was a victim of the shooting at Walpola Junction in Mulleriyawa.

President’s Counsel Thirantha Walaliyadda who is appearing for former presidential adviser Bharatha Lakshman Premachandra’s wife asked the CID whether they had arrested Duminda Silva who had been named as a suspect in the incident.
 
The CID detectives said they were unable to arrest Mr. Silva because he was in Singapore and pointed out that they had to act according to the laws that governed the arresting of a suspect who was abroad. The CID said it had sought the advice of the Attorney General in this regard (SRF, TFT)
