President rejects NCM brought against PM, Govt.

In a letter to Speaker Karu Jayasuriya, President Maithripala Sirisena yesterday rejected the No-Confidence Motion (NCM) brought against his nominee for Prime Minister Mahinda Rajapaksa and the Government.

In his letter, the President said proper procedures were not followed as was required by the Constitution and with regard to Standing Orders when submitting the No-Confidence Motion against the Prime Minister to Parliament.

President Sirisena said the NCM was thus passed without adhering proper parliamentary procedures.

The President shall appoint as Prime Minister the Member of Parliament, who, in the President’s opinion, is most likely to command the confidence of Parliament”, the letter read. The opinion of the President cannot be questioned or tested. He is expected to evaluate the prevailing situation and decide on the person best suited for the country.

It also said that there was no requirement as part of parliamentary proceedings or on the part of the prime minister to show a majority in parliament.

The President said he had also noted an attempt by the Speaker to send the documents of the Motion which announced that the No-Confidence Motion brought against Prime Minister Mahinda Rajapaksa and the Government had been passed in Parliament without a signature and had not been approved by Parliament.

    For once Sirisena has spoken with confidence. What he says is absolute truth and is in line with the constitution. PM can be from any member of the parliament ... not sure who was misleading as he need to be from the majority. In three years this was the first time I noticed that Sirisena is correct on his actions. (But) he still is a rogue no doubt on that.

    MS first received advise from his lawyers to dissolve Parliament and that was faulty. Now he says procedures not followed. What is needed in the Constitution is whether MR commands the support of the Parliament. MS is ill advised again. Education also matters when occupying high seats.

    MS is correct to say that when RW was appointed PM RW had only 42 seats. MS must understand no one challenged the appointment of RW as PM in Parliament. If some one challenged successfully RW would have lost the position. The present situation is similar

    If SC final verdict regarding the dissolution of Parliament by the President identified as against the constitution. We all want under article 38 (2) (a) 1. intentional violation of the Constitution. President need to be removed from his office. For the sake of democracy at least one MP hand over the letter to speaker signed by not less than one-half of the whole number of Members of Parliament please.
