In a letter to Speaker Karu Jayasuriya, President Maithripala Sirisena yesterday rejected the No-Confidence Motion (NCM) brought against his nominee for Prime Minister Mahinda Rajapaksa and the Government.

In his letter, the President said proper procedures were not followed as was required by the Constitution and with regard to Standing Orders when submitting the No-Confidence Motion against the Prime Minister to Parliament.

President Sirisena said the NCM was thus passed without adhering proper parliamentary procedures.

The President shall appoint as Prime Minister the Member of Parliament, who, in the President’s opinion, is most likely to command the confidence of Parliament”, the letter read. The opinion of the President cannot be questioned or tested. He is expected to evaluate the prevailing situation and decide on the person best suited for the country.

It also said that there was no requirement as part of parliamentary proceedings or on the part of the prime minister to show a majority in parliament.

The President said he had also noted an attempt by the Speaker to send the documents of the Motion which announced that the No-Confidence Motion brought against Prime Minister Mahinda Rajapaksa and the Government had been passed in Parliament without a signature and had not been approved by Parliament.

MS ans MR needs everything very favourable to suit them,

    Jaliya Thursday, 15 November 2018 01:08 AM

For once Sirisena has spoken with confidence. What he says is absolute truth and is in line with the constitution. PM can be from any member of the parliament ... not sure who was misleading as he need to be from the majority. In three years this was the first time I noticed that Sirisena is correct on his actions. (But) he still is a rogue no doubt on that.

Mr.President, how far are you gonna go with this? Please don't hold our democracy hostage for personal political survival.

    RP Thursday, 15 November 2018 01:11 AM

MS first received advise from his lawyers to dissolve Parliament and that was faulty. Now he says procedures not followed. What is needed in the Constitution is whether MR commands the support of the Parliament. MS is ill advised again. Education also matters when occupying high seats.

    Vaz Thursday, 15 November 2018 01:12 AM

Ok, let’s do it properly tomorrow.

Lal Fonseka Thursday, 15 November 2018 11:36 AM

It will not happen for sure, since MR and his party know they would loose the battle in the Parliament. So they have no other choice but make quarrel and find excuses.

The 'all knowing' president is trying to follow Jungle Law and dragging Sri Lanka into a further and deeper deadlock situation. If he has any concern for the country he will accept the verdict of the elected representatives! We have never seen such power hungry morons of this nature before!

MS is correct to say that when RW was appointed PM RW had only 42 seats. MS must understand no one challenged the appointment of RW as PM in Parliament. If some one challenged successfully RW would have lost the position. The present situation is similar

    Mandy Thursday, 15 November 2018 09:28 AM

But RW showed he had majority in Parliament quickly. But MR/MS combine evading that. Big difference from actual fact of majority as stated by MS in his "Opinion".

President is on right track on this subject. I was disturbed when I saw how speaker abandon his duties and let a group of MPs to to takeover the agenda. What a sorry state.

    Daya Thursday, 15 November 2018 02:52 AM

If SC final verdict regarding the dissolution of Parliament by the President identified as against the constitution. We all want under article 38 (2) (a) 1. intentional violation of the Constitution. President need to be removed from his office. For the sake of democracy at least one MP hand over the letter to speaker signed by not less than one-half of the whole number of Members of Parliament please.

Citizen Independant Thursday, 15 November 2018 02:52 AM

This is what you call a perfect mess with no viable solution on the horizon.

    Sofia Thursday, 15 November 2018 09:30 AM

And created by MS for personal revenge against RW. Not for benefit of country or people. Now desperate MS will do anything as desperation leads to paranoia.

Well done Mr President stand strong along with Mahinda and bring the speaker to Justice violating the democracy of the parliament and also of the country and its people. He has over ruled the head of state decision and appointments pushed by UNP, JVP and TNA.

The man who has plunged the entire country into total chaos - MS, must resign instead of desperately clinging to power. If he has a backbone, let him re-contest a presidential election and find out what the country thinks of him as a leader.

    fayaz Thursday, 15 November 2018 05:03 PM

For the best interest of the country RW and MR should get together and impeach the president. With the present one at the helm neither RW,MR or the country can hope for stability or prosperity,he started the chaos in which he has put our country in by initially backstabbing MR,its amazing still MR fell for him.
