Public trial will further damage judiciary: Ex CJ

Former Chief Justice Sarath N. Silva, while saying he was strongly opposed to the charges contained in the impeachment motion against Chief Justice Shirani Bandaranayake being made public, said the Select Committee should not be given judicial powers because the exercise was purely of a disciplinary nature relating to a contract of employment.

“Both the charges and the response have been made public and this issue now moves into the realm of a public trial, which will only harm the judiciary further. I’m strongly opposed to the charges contained in the order book being made public,” he said.

Mr. Silva said he experienced the same predicament when the United National Party (UNP)-led coalition attempted to impeach him.

“This happened to me, when charges against me were made public. I had no option but to sit and stare at the order book because I was never given an opportunity to respond to them. A select committee was never appointed and to this day there are many who believe that these charges against me were well founded,” Mr. Silva said.

He said the matter was solely of an administrative nature and not founded on any criminal allegations and that the Parliament Select Committee (PSC) should not have judicial powers.

“This is clearly a matter of discipline. The real question is if there was a violation of the terms of employment between the judge and the government of Sri Lanka, it is purely a disciplinary issue therefore the select committee should not have judicial powers,” he said. (Hafeel Farisz)

Quite so!. Why doesn't SS keep his mouth shut and let the Sri Lankans sort out the problems created by him?.

Al Rasa Saturday, 10 November 2012 03:23 AM

Now for every resolution by the govt. you oppose. When in the office nothing was done to correct anything by you.

frank hilary Saturday, 10 November 2012 03:32 AM

I think its high time SS shut his gab since he is the person who as CJ paved the way for the present political mess in this country.

Sarath Silva was the worst hypocrite of a judge. His egregious & despicable antics within & outside the precints of the hallowed Supreme Courts is proverbial. He is having a misguided conception that by offering flowers & preaching Bana while portraying himself to be an expert of Lord Buddhas Teachings, all his past transgressions will absolve into oblivion.
Well MR. SILVA you are wrong. You are a treacherous, heartless, decrepit old fossil, whose dictatorial attitude caused immense hardships & misery to many people. You are a tyrant & have no moral right to even proffer advise to a kindergarten kid.

The only legacy that you have left for the denizens of Hultsdorf to remember you by, is a bloated ego of a tyrannical manic, who turned out be a pathetic joke by denigrating the principles of the highest office of the Judiciary.

The main person who spoil the thing trying to become a saviour.

    Ahmad Friday, 09 November 2012 04:05 PM

You know very well because of you whole country is suffering now. Can you deny Mr Silva?

    R.Dias Friday, 09 November 2012 04:22 PM

You are the one who should be held responsible for all what is happening....if you had just declared the 2006 crossovers invalid..

    Rohan Saturday, 10 November 2012 01:34 PM

You are the cause for all these problems by putting horns to a horse's head. Now the horse started to run wild.

This man is the biggest criminal who damaged the reputation of the Judiciary. He has turned 180 degrees after meeting the Regime King at the funeral of late Justice Wanasundara. Probably, would have offered an envoy position in return to convince the incumbent CJ to resign.. What an idiot.

    MAN Saturday, 10 November 2012 06:31 AM

I FULLY ENDORSE FORMER CJ'S NEUTRTAL STATEMENT AND IF IMPLEMENTED ACCORDINGLY TEH THINGS WILL PROCEED PEACEFULLY. THIS IS WHAT WE NEED OF THE HOUR

ranna ponnil Friday, 09 November 2012 11:21 AM

The bottom line is this , you can be the worst criminal but if you fall in line with them, you will be given the best treatment. Similarly, even if you are an angel you will be severly punished if you get in to their bad books, even for good reasons!

    Jiffry Friday, 09 November 2012 11:58 AM

because of his bias judgements today this government enjoying the two third majority . Srilankans judiciary is being harmed due to this Executive Presidency.

    NSJPerera Friday, 09 November 2012 12:17 PM

He seems to have conveniently forgotten the damage he did to the judiciary.

    Mason Friday, 09 November 2012 12:21 PM

You cleared a guilty person then. The country suffers now. Had you done your job as required we will not be in this predictment.

    Lobo Friday, 09 November 2012 12:30 PM

Maybe they should just drop the case like you did with the H'tota case.

    Hettiarachchi Friday, 09 November 2012 12:35 PM

They should have brough an impeach motion against you for your judgment on the Helping Hambantota case.

    DUWI Saturday, 10 November 2012 08:36 AM

    You started the damage.

    Anil Friday, 09 November 2012 12:59 PM

MR has a 2/3rd majority because Sarath Silva permitted cross overs. Humbug.
