Fonseka skips Court Martial

General Sarath Fonseka was not present today at the second court martial hearing at the Navy Headquaters in Colombo as he was in parliament since this morning.

Military Spokesperson Major General Prasad Samarasingha confirmed that the General was not present at the second court martial hearing today but was represented by his lawyers and added that the hearing will resume tomorrow afternoon.

"General Fonseka did not attend the Court Martial but he was represented by his lawyers. The Court Martial will resume again tomorrow afternoon," Major General Samarasingha said.

General Fonseka had been granted permission to remain in Parliament during today's sessions by Speaker Chamal Rajapaksa after the General informed parliament earlier today that a Court Martial sitting had been fixed, despite the Parliamentary sessions. (Daily Mirror online)

    ND. Rule is a rule. Another MP can also ask for a fresh date. After all, that is why lawyers are for. To represent a defendant in courts.

    All these court martial and detentions are due to going aganst goverment (MR) nothing else.

    This shows he has something to hide. He took the advantage of attending the parliament to avoid the tribunal. But you can't hide like this. If you are not guilty, face the truth General.

    Military tribunals are not courts of law, Courts of Justice is a part of the Judiciary like Parliament the Legislative arm and cabinet the executive arm. Military Tribunals are formed under the Army Act witch cannot supersede parliament. If Sarath Fonseka was charged in a Criminal Courts he has to keep date with courts,go to courts first.

    Where exactly in the law that says that parlliament member can not be attained court of justice just because of he/she has to attaend parliament ? After all nobody is above the law. Fonseka is just hiding behind the parliament privileges. He is only a coward.

    What would happen if another MP was called before civil or criminal courts and he skipped that on the pretext of attending parliament?
    Would Parliamentary previleges be cited in the excuse? I wonder. Let us consider this without considering whether the MP is green, blue, red, blue-green or purple. :)

    The court martial should've not taken place when the general was attending parliment, which is by the way within his constitutional and legal rights, instead the prosecutors should've been informed to postpone the hearing like they have done now. It doesn't show that he is hiding anything it shows that the parliment or constitution is not above the army as it is supposed to be...

    it is a must that parliament members should be present in the chamber while in session unless they have obtained prior permission.. knowing that, why did the court martial go on?? the military knew there was parliament today. so why couldnt they postpone it?
