The Supreme Court has granted leave to proceed in a Fundamental Rights petition filed by Anoma Fonseka on behalf of her husband General Sarath Fonseka who has been detained by the Military police.

The Fundamental Rights petition seeks the right to freedom from torture, arbitrary arrest and detention. The case will be heard on February 23. Meanwhile the Attorney General gave an undertaking that General Fonseka will not be transferred from the place where he is being detained at the moment. (SSS)

    Friday, 12 February 2010 09:38 AM

This is the fundamental rights issue but army court martial is a different issue altogether. Lets see is Anoma's crocodile tears will answer the fundamental rights issue.

    Friday, 12 February 2010 09:39 AM

Justice must not only be done, justice must appear to be done. This is an excellent test case for independence of judiciary.

    Friday, 12 February 2010 10:04 AM

What a joke to wait for eleven more days when presumption of innocence in law is violated by detaining SF for more than four days already. This appears to be another ploy by the blue tigers.

    Friday, 12 February 2010 10:04 AM

This is a case of national importance. Sarath Fonseka is the voice of 4.2 million citizens of this country. Why can't the courts treat this as of emmergency? Is the courts going to sleep with the case till 23rd by which time dead line for filling the petition against the presidential election expires? Entire judiciary is paid by the tax payers of this country. Why can't the judiciary understand this? Are they playing politics?

    Friday, 12 February 2010 10:07 AM

A nation looks up towards or chooses a leader to "LEAD" so that its children could seek a youth full of choice. Grow older and finally mould into a prosperous nation. If a leader shows that he is only in power to rule by Decree and Severity, the peace loving people commence to sharpen their swords, one has the sword already sharpened and the opponent is sharpening his. This finally leads to civil war.

    Friday, 12 February 2010 11:08 AM

local boy, keep Karuna, Pillayan, KP in palace, Send SF jail for lifetime for destroying LTTE and Prabakaran. wonderful.

    Monday, 15 February 2010 04:31 AM

Please enlighten the public on what the charge/s are. Is it that he gave out secrets while he was army commander, was it because he planned a coup & assassinations of the royal family, was it the secret deals? Is it one of all these reasons. If it was the 1st, the 6 months period was up in Dec.

    Friday, 12 February 2010 08:42 AM

We saw the fearless actions of the lady Chief Magistrate. Now we expect similar action from the Higest Court in Sri Lanka. Long live Justice in Sri Lanka!

    Friday, 12 February 2010 09:03 AM

"court to hear Fonseka case" doesn't mean that he is not guilty. Case will hear and some time more cases will add to his charge sheet within the hearing.

I think that the Courts should take this application as an urgent matter and dispose the case immediately. No point in postponing it till 23rd.
