Six-month suspended sentence for sharing friend’s girlfriend’s nude photographs via WhatsApp

Colombo, Jan. 23 (Daily Mirror) - A young man who was charged with sharing his friend’s girlfriend’s nude photographs and videos with other friends was sentenced to six months of simple imprisonment, suspended for a period of ten years, by Colombo Chief Magistrate Asanga S. Bodaragama today.

The Magistrate further ordered the suspect to pay Rs. 75,000 as compensation to the victim.

According to the facts presented before court, after the complainant and her boyfriend ended their romantic relationship, the complainant and the suspect who had been in contact from the beginning, continued to communicate frequently over long periods. During this time, the complainant had sent nude photographs of herself to the suspect. The suspect later shared those photographs in a WhatsApp group consisting of his friends.

Upon becoming aware of the incident, the complainant lodged a complaint with the Computer Crimes Investigation Division.

Appearing on behalf of the suspect, defence counsel submitted that the suspect had not subjected the complainant to any threats or undue influence and that he had admitted to the offence at the earliest opportunity. Counsel further informed court that the suspect had pleaded guilty at an early stage of the proceedings and accordingly sought a lenient sentence.

After considering all the circumstances, the Magistrate imposed a sentence of six months simple imprisonment, suspended for ten years, ordered the payment of Rs. 75,000 as compensation to the complainant and imposed a fine of Rs. 2,500.

Defence counsel further requested a period of one month for the suspect to pay the compensation, which was granted by court.
