Indictment filed in Kandy HC against Minister Janaka Bandara Tennakoon Court of Appeal dismisses indictment

The Court of Appeal yesterday dismissed an indictment that has been filed in the Kandy High Court against Minister Janaka Bandara Tennakoon by the Attorney General over a murder that took place in 1999.   

The two Appeal Court Judges H.A.M.D. Nawas and Sobitha Rajakaruna on conclusion of the inquiry into the appeal, issued a writ order nullifying the indictment and ruled that the indictment filed in the Kandy High Court is erroneous and unfair and to terminate further trial in the Kandy High Court.   


Minister Janaka Bandara Tennakoon by the appeal, challenged the Kandy High Court case alleging that while a case had been filed against a convict in a murder that took place in 1999, filing another case for the same matter in the Kandy High Court against the Minister in 2015 is not proper and unfair.  


He had also alleged that the Kandy High Court had held a summary trial in a day against the Minister and had issued the order against the Minister.   


Minister Janaka Bandara pleaded that the indictment was not proper, erroneous and unjust, and therefore to dismiss the indictment filed in the Kandy High Court by the Attorney General.
