SF’s appeal to be heard

The Court of Appeal today rejected the preliminary objections raised by the Attorney General on the maintainability of the Writ petition filed by former army commander Sarath Fonseka.

Three-judge Bench comprising Justices R.L.Ranjith Silva, A.W.A.Salam and Upaly Abeyrathne, after having rejected the preliminary objections, fixed the Writ application for argument on May 3. Objections, if necessary, are to be filed on or before April 25.

In the light of recent determination by the Supreme Court in respect of Court Martial, the Court of Appeal had, on February 11, reserved its order to pronounce on the question of maintainability of the Writ seeking the court to enable him to sit and vote in Parliament and to exercise his powers, privileges and immunities as a Member of Parliament.
