General Anuruddha Ratwatte has appealed to the Supreme Court against the judgment of the Court of Appeal remitting the bribery case back to the High Court for further trial.
Ratwatte, who functioned as the Deputy Defence Minister and Minister of Power, Energy and Irrigation and is presently the National Organizer of the SLFP, filed his petition for special leave to appeal through his Attorney-at-Law Gowry Shangary Thavarasha.
The petitioner stated that the Commission to Investigate Allegations of Bribery or Corruption required him to show cause in respect of several matters referred to therein. He said he replied to the notice showing cause.
He claims that he did not receive any further written communication from the Bribery Commission regarding any decision but thereafter he was indicted before the Colombo High Court on charges of relating to offences that are alleged to have been committed under the Bribery Act.
He stated he pleaded not guilty to the charges in the indictment and thereafter the trial commenced. He further stated that the High Court upheld the objections raised on behalf of him and discharged him.
He stated the Respondent Director General of the Bribery Commission appealed to the Court of Appeal for revision against the order of the High Court which had set aside the order of the High Court and remitted the case back to the High Court for further trial.
Petitioner Gen. Ratwatte in his application for special leave to appeal urged the Supreme Court to set aside the judgment of the Court of Appeal.
