MCC Compact inconsistent with Constitution: AG informs President’s Secretary

Attorney General Dappula de Livera advised Secretary to the President P. B. Jayasundera that the Millennium Challenge Corporation (MCC) Compact is inconsistent with written laws and the Constitution.

AG’s Coordinating Officer said the Attorney General had informed the Secretary to the President that Program Implementation Agreement (PIA) and Articles of Association of MCA are also inconsistent with the written laws and the Constitution.

This was informed to the Secretary to the President in writing after considering the findings on the MCC of the respective state institutions including the relevant Ministry and the recommendations of the report of the Committee appointed by Prime Minister Mahinda Rajapaksa to review MCC agreement were taken into account.

Thus, the Attorney General said there was a legal barrier in implementing the MCC agreement. 

The government led by President Rajapaksa suspended the proposed MCC agreement in December 2019 and a four-member committee was appointed to review the agreement and submit recommendations to the Cabinet.

Accordingly, the final report of the four-member committee was handed over to Prime Minister Mahinda Rajapaksa on June 24, 2020. (Sheain Fernandopulle)
