Lawyer files contempt of court case against Sanath Nishantha

A lawyer today filed a contempt of court application in Court of Appeal seeking an order directing the Attorney General to draft charges against Sri Lanka Podujana Peramuna (SLPP) parliamentarian Sanath Nishantha for committing the offence of contempt of court.

The petitioner Priyalal Sirisena, an Attorney-at-law by profession filed this application naming Puttalam District Parliamentarian Sanath Nishantha, the Bar Association of Sri Lanka and the Attorney General as respondents.

The petitioner is seeking an order to impose sentence on Sanath Nishantha for committing the offence of contempt of court punishable under Article 105(3) of the constitution. (Lakmal Sooriyagoda)

Not only contempt of court issue, this fellow Sarath Nishantha had raped so many innocent poor Fisherman's wives, its true, you could investigate and find the facts.

Maybe finally we see Article 105(3) changed Monday, 29 August 2022 04:25 PM

Maybe the law can be changed finally about insulting the judiciary. I expect the MP is not complete fool, but confident with his party, such that before things go along too much the SLPP can get rid of the archaic law about treating the judiciary as gods. MPs are always made fun of and criticised, and they know it's how the business is. President and his office is continuously criticised nowadays, and unlikely once that's started it will ever stop. If this means freedom comes about to criticise the judiciary when necessary for the benefit of the general public. Good for the MP speaking his viewpoint, but good for Attorney-at-law too for taking action against him on Article 105(3). 2/3 majority of parliament should be able to get together to end this Article madness. Then MPs can have more freedom. If SJB boycotts for changing Article then we know they don't appreciate for Ranjan.

This MP had done far worse than Ranjan. MP Sanath is completely out of order with criticising judges as he had. He is doing for SLPP purpose, not to improve country. While this unfair horrible law is under the constitution is must be used to punish him as past MP Ranjan was.

The difference here is that MP sanath Nishantha has made specific allegations and provided valid arguments. Of course the conduct of the judiciary can encourage or discourage people to abide by or break the law. That is the fundamental reason for the existence of the Criminal Justice System. Ranjan on the other hand said most judges and all lawyers are corrupt. Without any specifics or examples. Of course one could observe most lawyers in our courts look at the average time it takes to complete a case to come to a similar conclusion about lawyers and the BASL that perpetuates the corrupt practice of lawyers of prolonging cases to take more legal fees but Ranjan did not give reasons.
