Notices issued on Speaker and PSC members

The Court of Appeal today observed that it has the jurisdiction to hear the writ petition filed by Chief Justice Shirani Bandaranayake challenging the findings of the Parliament Select Committee (PSC) and as such issued notices on the Speaker and PSC members returnable on January 3, 2013.

The Appeal Court also observed that the Speaker and the PSC members should advise themselves not to act in derogation of the rights of the CJ and that any act disregarding the ongoing case and moves to alter the status quo may lead to a chaotic situation in the country.

    In Sri Lanka becoming as a Lawyer is a big task. Competitive examination, then learning and passing examinations in the law college. To become as an MP every one knows, how it is done here. Then the MP gets automatic permission to study in the law college to become as a lawyer.
    So people know a simple Lawyer or a simple MP is well educated person.

    Yes, constitution is supreme and that constitution also has checks and balances which places actions of parliament beyond questioning by the judiciary other than where it is allowed [eg. constitutional validity of acts] by the constituion itself. Creative judicial activism like this excercised to cover up CJ and further political agendas are not acceptable and will result in chaos which will be more deleterious to judicial system than anything else.

    Whatever the motive gov has followed procedures laid down by the constitution and it is ridiculous to suggest constitution breaches Natural Justice and Equality of Treatment. In that case why did CJ make the oath to uphold the constitution when she was sworn in as CJ ????
