Nalini knocks on HC door again

CHENNAI: More than seven months after an advisory board rejected her plea for premature release for the second time, Nalini Sriharan, serving life term in the Rajiv Gandhi assassination case, has approached the Madras high court again seeking early release.

Justice M Sathyanarayanan, before whom the petition filed by Nalini came up for admission on Monday, asked the government to submit its response by November 30.

Nalini, who is in jail for more than 19 years now, has said that on March 24 the state government issued an order accepting an advisory board's recommendation and rejecting her plea for premature release. Urging the court to quash the order, Nalini said: "Instead of considering the object of premature release, reformation and rehabilitation of the prisoner concerned, the state has unfortunately considered the nature of the crime committed by a life convict, for which she has been punished in accordance with law."

She also stated that the Tamil Nadu government had ignored the observations of the Supreme Court in the Maru Ram Vs Union of India case, and the observations of the apex court judge, Justice KT Thomas, in the Rajiv Gandhi assassination case.

Instead of considering these judicial observations and the object of the premature release scheme in proper perspective, the government had heavily relied on the observations of the advisory board for rejectiong her request, the petition said.

The advisory board had stated that the crime committed by her was heinous in nature and she had harboured the prime accused involved in the assassination of the former prime minister. It also concluded that Nalini was part of the conspiracy. However, Justice Thomas, in the judgment in assassination case, had observed that Nalini was not aware of the assassination plot till the last minute.

This is Nalini's second writ petition seeking the high court's intervention for her early release. On October 31, 2007 the government first rejected her plea. When she challenged the decision, the high court passed an order on September 24, 2009, directing the government to re-constitute the board as per law and pass an order after considering all relevant factors. After the reconstituted board too rejected her plea, the government issued an order on March 24 this year accepting the recommendation.
