Justice D.S.C.Lekamvasam a member of the Court of Appeal bench hearing the writ application seeking the release of General Sarath Fonseka declined to sit on the bench today citing “personal reasons.” He will be replaced by justice Anil Goonarathna.
The Habeas Corpus application was filed on Thursday by Mrs. Anoma Fonseka seeking the Court to direct the Army Commander, Army Provost Marshal and Navy Commander to produce Gen. (Rtd) Sarath Fonseka to the Court to be dealt with according to law and to discharge him.

DPL - if justice D S C Lekamvasam was all that good should he have not stood his ground in the case and given the verdict in favor of the General rather than running scared?

justice D S C Lekamvasam is a relative of SF/Tillakaratne families. His honesty shows that he abstained for sitting this hearing as he has known relation to complained party.

It would have been better if the members of the panel of judges selected and agreed before the sitting so that there was no need to postpone the hearing for another date.

The justice D S C Lekamvasam is a very good example for other judges, the person of high level honesty and intergrity. not above the LAW.. The president of the country until his term of president HE should not summon to courts.but he is not above the LAW.

The learned judge either would have been under threat or would have wanted to avoid involvement in a judgement that could be a threat to his life and family.
