The Government today asked Speaker Chamal Rajapaksa to take action against UNP MP Wijeyadasa Rajapakshe for his involvement in legally challenging the parliamentary process to impeach Chief Justice Shirani Bandaranayake.

The Speaker said he would examine the matter and take appropriate action.

Deputy Health Minister Lalith Dissanayake, raising a point of order referred to the Speaker’s ruling that court proceedings had no binding on Parliament and asked about Mr. Rajapakshe’s involvement in the judicial process against the Parliamentary Select Committee (PSC).

“I do not know how Mr. Rajapakshe as a member representing this august assembly has legally challenged this process. He has done it despite the Speaker’s ruling. It is true that he is the President of the Bar Association. But, he cannot do so as an MP,” Mr. Dissanayake said.

However Opposition Leader Ranil Wickremesinghe argued that in this instance Mr. Rakapakshe had acted as the President of the Bar Association and not as a legislator.(KB & YP)

Members of the parliament are there to represent the people, not the parliament, I suppose.

    sbd Wednesday, 05 December 2012 03:00 AM

We have another dictator in parliament, hiding behind parliamentary privileges issuing dictates daily against judiciary which serves only to demean respect public has that it is the only salvation they had against power hungry regimes.
Any citizen whether MP or not of this country has the right to challenge any action of anybody when his/her fundamental rights are violated in gross breach of Constitution. This is exactly what Mr Wijedasa Rajapakse is doin.

obivious eater of shit of govt!

    sbd Wednesday, 05 December 2012 03:08 AM

Well said. The 2/3 majority of MPs of the government are not elected by people at the last election in the name of this government. These are mere cross over from opposition for perks ,power & permits!. Therefore this parliament does not represent the true openion of the majority of the people. When its very mandate is thus in question, how does it get spremacy, except by eye wash for it is not true representation of the peoples will of this country now.

    MWTA Wednesday, 05 December 2012 03:33 AM

Wara you are mistaken. Parliament that is consisting a set of jokers who were selected by various means, enacts the Law/s in the country.
But it's up to the Judiciary/ Supreme Court to make sure that the enacted laws are properly maintained including the Parliament and it's members subsequently. Because the Parliament enacts laws it does not mean there are subsequently not bound by the law. They are bound by the law.

Karunasena de Silwa Wednesday, 05 December 2012 03:52 AM

Speaker of the parliament is not a super human or a god.

SAMAN DOLOSWALA Wednesday, 05 December 2012 04:19 AM

Deputy health Minister Dissanayake is not an educated person. He merely put forward what another fool had asked him to do.

    disgraceful conduct of a MP

Damma Deepa Wednesday, 05 December 2012 02:19 AM

Very soon the Speaker will start a coming to Huldsdrof Court Complex in the morning on his way to the Parliament and sit on the Supreme Court Bench and hear cases and pass the judgement for their clients? Mr. Wijedasa, you can submit your matters and argue. Hon. Dr. Shirani you, can fly a kite without wasting your valuable time?

    Marikkar Wednesday, 05 December 2012 06:03 AM

Absolutely right. I was extremely shocked with the way Mr. Wijedasa hadled the discussion in Rathu Ira with Sihala Urumaya Chief Monk on the Involvement of of Priests in Sri LAnkan Politics. A very talented, polite and resourceful professional, but unfortunately he is seated along with Papa Ranil in the opposition.

    Bandu Wednesday, 05 December 2012 08:02 AM

what a funny topic for the press? can anyone tell what the constitution says? what do you mean by the interpretation of the constitution? can the supreme court say white is equal to black as it has the full power to do that? Real funny topic. Peoples have elected people to represent them in the parliament. CJ is just a person not the judiciary. X goes and Y comes. no government officer can demand to stay in any position. whether write or wrong, our court taught us to be refer to the legal books. they never considered how ethical or natural justice against us but for them?? interesting.. isn't it?

    xlntgson Thursday, 06 December 2012 01:22 AM

Ayes only; no nays! Separation of powers guaranteed only with undissent, eh?

Tilan de Hoot Thursday, 06 December 2012 06:07 AM

Well said Dave. These lawyers are nit. Even their black coats have been taken on hire.

    A Lawyer Tuesday, 04 December 2012 12:24 PM

    @ Dave

We don't eat cowdung. I know the constitution. But As Lawyers We act on our rights and for the sake of the Country. Don't be misled as donkeys who were along the road in front of Supreme Court today. You also seems to have some connection to brothers.or may be from south.

Sonna Boy Tuesday, 04 December 2012 10:52 AM

We need more politicians like mr wijedasa rajapakse

    A Lawyer Tuesday, 04 December 2012 10:49 AM

who is chamal to give orders to lawyers? Other thing is we did not appoint any one called chamal.

    Achari Tuesday, 04 December 2012 10:49 AM

    Well said Mr. Wickramasinghe.

Impartial guy Tuesday, 04 December 2012 11:03 AM

Let him be a Legislator, Lawyer, or a Citizen, He/she should have the freedom expressing his opinion. If that is the case, how come Speaker says, he or any committee appointed by him is not suppose to accept any notice issued by Supreme Court. If this issue goes on like this, public will start saying they are not suppose to take any orders from Court as public is Supreme. Let's stop this nonsense, and do something meaningful.

    Nodrog Tuesday, 04 December 2012 11:25 AM

Good to see you guys so scared and worried. The truth will soon be known then there won't be anywhere to hide your faces.

    Nodrog Tuesday, 04 December 2012 11:26 AM

The Govt is resorting to so many dirty tricks but the majority of the people are not going to be fooled this time. We are waiting for the sparks to fly.

    Wara Tuesday, 04 December 2012 11:23 AM

Chamal is the Speaker of the parliament. Only second to President if he present in the parliament.

    Muthu Tuesday, 04 December 2012 11:43 AM

Yeah, 'speaker of parliament" where chain snatchers, drug dealers and common thugs sit thanks to idiotic and hoodwinked voters.

    Cobbler Tuesday, 04 December 2012 11:43 AM

Turning to all the dirty tricks including demonstrations against the CJ clearly shows that they have no weight in the Impeachment !

    A Lawyer Tuesday, 04 December 2012 11:59 AM

We know who is Chamal. But he has got nothing to do with the Lawyers. His Orders are not binding to us, may be he can order fools at Parliament.

    dave Tuesday, 04 December 2012 12:03 PM

    Hey Donkey Lawyer,
Read the Constitution of Sri Lanka.
Do not eat cow dung when Cheses/Butter and Milk are available

    Iqbal Tuesday, 04 December 2012 12:10 PM

    Very well said.

Calistus Jayatilleke Tuesday, 04 December 2012 12:24 PM

How can ex-cop teach law to the lawyers and judges. This sort of thing can happen only in the Debacle of Asia. Wijayadasa Rajapakse, whilst being a MP, is also the President of the Bar Association; hence he has a responsibility to safeguard the judicial system of the country. At this rate, very soon the government will end up with egg on its face and being the laughing stock of the whole world.

    galapitamada Tuesday, 04 December 2012 12:26 PM

Speakers Ruling is binding on all legislators according to our constitutioncand he is the head of state in the absence of the president but the fact is most unfortunately the rajapakse ruling family is using it to their personal advantage .not for the advantage of the country

Real Peace Tuesday, 04 December 2012 10:49 AM

He is a man made of steel, I have a great deal of admiration for him.

    A Lawyer Tuesday, 04 December 2012 12:31 PM

Constitution may be superior. Supreme Court is the one which is solely empowered to interpret the Constitution.

    Roshan Tuesday, 04 December 2012 12:32 PM

I DON NOT KNOW SOUTHERN PART OF SRI LANKAN SO ARROGANT,THEY BEHAVE LIKE BARBARIAN

    Upul Tuesday, 04 December 2012 12:32 PM

Of Course Sonna Boy. It is because the majority of the Opposition is silent on matters like these that we are saddled with a dictatorial Government.

    rajiv Tuesday, 04 December 2012 12:40 PM

Like how the SC cannot interfear with the Parliamentary proceedings Others cannot dictate terms to the Courts.

    Nasrullah-Beruwala Wednesday, 05 December 2012 12:54 AM

but, No one speak (including speaker chamal) against mr.kumara welgama about his bad attitude in parliament !

    usaguy Wednesday, 05 December 2012 01:40 AM

Please correct me if i am wrong. As far as I understand the three branches, the President, The Legislature and The judiciar are all independent bodies. No one should interfere in the other. That's why the president keeps telling that he will never interfere in the judiciary. What I cant understand is why the impeachment, why cant the president just sack a SC judge because he is the one who appoints them.

    shah Wednesday, 05 December 2012 01:41 AM
