Former CJ faces probe

In a surprise development former Chief Justice Sarath N. Silva is likely to face a scrutiny after a group of retired judges yesterday met President Mahinda Rajapaksa at Temple Trees and appraised him of what the presidential office said was, “sending them on retirement in an unfair manner” during Mr. Silva’s tenure in office.

The former Chief Justice had been openly critical of the present regime in recent months and appeared on the platform of the People’s Democratic Forum where he spoke on the topic, ‘Is the executive a challenge to people’s sovereignty.’

Last week he was the chief guest when a Janatha Vimukthi Peramuna (JVP) affiliated organisation launched its website called Voice Against Corruption. The convener was JVP MP Sunil Handunnetti.

The retired judges told President Rajapaksa that as many as 42 judges were compelled to retire on the influence of Mr. Silva at the time he was Chief Justice. They said some of the retired judges had committed suicide and some others suffered mental and physical shock following their ignominious retirement.

They requested President Rajapaksa to initiate an inquiry into the happenings in the judiciary between 1999 and 2009 under the then chief justice Silva and take steps to alleviate their grievances.

Parliamentarian Janaka Bandara who joined the discussion drew the attention of President Rajapaksa to an article published in the ‘Ravaya’ newspaper. He pointed out the necessity to make an inquiry based on the exposures in Ravaya and other allegations against Mr. Silva.

External Affairs Minister G.L. Peiris and presidential secretary Lalith Weeratunga assisted the President at the meeting with the 14 retired judges. (Sandun A. Jayasekera)

    The formula is very simple.

    If you are from ruling side, nothing can be done by any (police/army/courts) charges will be dismissed unanimously. Evidence will be disappeared or deleted. Further you will be called - Patriots (Desha Premee)

    But if you are from opposition, everybody will activate to arrest you failure charges will be fabricated, evidence will be created to put you behind bars. They will be called - Traitors (Desa Drohee) also they will be accused making conspiracy with International support.

    Emotional politics is in full swing at the expense of minority & opposing ideologists.

    those who make curruption and mischief in the land of God shall face justice one day, donot plot in the land of god, for god is the best plotter. dear retired judges, dont add fuel to the burning fire, for u all know that the Former CJ Sarath N. Silva is in rift with the current Government and u retired judges are trying to make a way out of it. let the past be gone, forget and forgive those who harm u as the teachings of Buddha, instead dont do other wise, if CJ really did injustice he would be ashamed of himself. Surely God knows best what is in ur heart.

    If, as was mentioned, a highly intelligent person such as a judge committed suicide for losing his job, definitely he would not have been suitable enough for that job of high responsibilty. He had not been able to be responsible for his own life!

    If retired judges had committed suicide and some others suffered mental and physical shock following their ignominious retirement, What about the innocent people they punish who did not commit crimes but loss cases due to weaknesses of the lawyers and the judiciary systm or even cases framed by peoploe who had power ?

    If some of the judges committed suicide because they were forced to retire they were definitely not fit to be judges in the first place and probably did deserve to be asked to retire!
